PR-IFCAP: 519-23-3-984-0607 Description of Action: A search of the equipment shows that the manufacture PHS West which is a Small Business. The market research also indicates that this equipment can be supplied by an authorized SDVOSB. PHS West has provided a Sole Source Letter, please refer to the P03 Sole Source Letter. Order against:� ���FSS Contract Number: 36F79723D0090 Name of Proposed Contractor: Aldevra LLC Street Address: 3707 South Westnedge Ave City, State, Zip: Kalamazoo, MI 49008-2979 Phone: 269-350-1337 Description of Supplies or Services: The estimated value of the proposed action is $20,925.00 West Texas VA Health Care System (WTVHCS) has a requirement for a motorized heavy duty platform cart, ceiling lift load test sling, and weights for ceiling lift load test cart. The equipment is necessary for BioMed to perform a load test on the patient lifts at our facility. It is a requirement for patient safety, and we are mandated to perform load tests annually to remain in compliance. Authority: Order Against FSS:� Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6.� Mark the applicable exception: ��An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A); ��Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; (FAR 8.405-6(a)(1)(i)(B)); ��In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405-6(a)(1)(i)(C)); or ��Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). Rationale/explanation to support cited authority: FAR Part 10 was followed when conducting market research. Utilizing NAICS Code 333923 and the keyword ""Motorized Lift Cart,"" market research was carried out with GSA Advantage, FPDS, SBA DSBS, and VetBiz. GSA Advantage search using the keyword resulted in 60 vendors. Those results were narrowed to only SDVOSBs/VOSBs, which revealed 2 found vendors. A further search found that Aldevra, the authorized vendor that PHS West works with has a FSS Contract. A search in GSA showed that Aldevra who is PHS West�s authorized vendor has a FSS contract. A search in FPDS using the keyword resulted in multiple Purchase Orders. A search in SBA DSBS shows that PHS West is listed as a Small Business. A VetBiz search using the NAICS Code, and the keyword resulted in 4 SDVOSB�s. A search of the equipment shows that the manufacture PHS West which is a Small Business. The market research also indicates that this equipment can be supplied by an authorized SDVOSB. PHS West has provided a Sole Source Letter, please refer to the P03 Sole Source Letter. Note that this determination satisfies the requirements of FAR 8.405-6.� The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
