Description
Notice of Intent to Sole Source The National Institute of Standards and Technology (NIST), Engineering Lab (EL), Materials and Structural Systems Division (MSSD), intends to negotiate, on a sole source basis, under the authority of FAR 13.106(b)(1), with Malvern Panalytical, Inc. to acquire the Epsilon 1, portable XRF spectrometer instrument. Background Information and Basis for Sole Source NIST, EL, MSSD requires a portable, energy dispersive XRF spectrometer instrument to give provide measurement capability for assessing the elemental composition of infrastructure materials both in the laboratory and in the field.� The instrument must provide performance equal to comparable laboratory XRF spectrometers on solid, powder and liquid specimens, which are essential for the infrastructure composite materials. The Malvern Panalytical Epsilon 1 is the only portable XRF spectrometer instrument manufactured to measure powder, liquid and large, irregular shaped objects with maximum dimensions of 8 cm x 12 cm x 12 cm (H x W x D) that weigh up to 2 kg. Furthermore, the Epsilon 1 is the only portable XRF spectrometer instrument capable of 1) analysis of lighter elements, including chlorine and sulfur, due to its use of a Ag x-ray anode for the best peak separation from line overlaps for the light elements, 2) a standardless calibration for unknown samples (solid, powder or liquids) or where certified standards matching specific samples are not available; and 3 ) auto drift correction of the X-ray source of the instrument. No other known product possesses the portable capability in addition to the other required critical features. Malvern Panalytical, Inc. is the only manufacturer that sells a portable XRF spectrometer instrument needed to directly compare measurements in both the laboratory and in field operations, in which the environment includes high temperature and humid conditions, for light elements. If the Malvern Panalytical Epsilon 1 cannot be purchased, it would result in the inability of the government to complete several projects in EL�s Engineering Materials for Resilient Infrastructure Program in the defined timeframe and unable to move forward with the research. As such, the Government�s intent is to negotiate with Malvern Panalytical, Inc. to acquire the Epsilon 1, portable XRF spectrometer instrument. General The North American Classification System (NAICS) code for this acquisition is 334516-Analytical Laboratory Instrument Manufacturing. The small business size standard is 1,200 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by the listed due date, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response due date for this notice. All responses to this notice of intent must be submitted so that they are received at seth.kaplan@nist.gov no later than the aforementioned due date.
