Description

NOTICE OF INTENT TO AWARD SOLE SOURCE Project Title: Microwave Digestion Vessels for use with CEM MARS Xpress and MARS 6: Four (4) MARS Xpress TFM Vessel Starter Set, 40 place, 55 mL, Twenty six (26) Xpress TFM Vessel Replacements, 55 mL and Twenty six (26) Xpress Vessel Vent Plugs. Announcement No: FDA-23- 1267934 The Government hereby submits a notice of intent to award a sole source contract to CEM Corporation for the Microwave Digestion Vessels for use with CEM MARS Xpress and MARS 6: Four (4) MARS Xpress TFM Vessel Starter Set, 40 place, 55 mL, Twenty six (26) Xpress TFM Vessel Replacements, 55 mL and Twenty six (26) Xpress Vessel Vent Plugs. The total estimated value is less than $48K. This sole source contracting action a notice pursuant to FAR 5.203(a) for the requirement based on the application of FAR 6.302-1. This hereby constitutes a synopsis of this requirement. This is an award under NAICS Code 334516. Since the San Francisco Elemental Analysis group already owns four CEM microwave instruments that are compatible with CEM Corporation consumableequipment, they need the Mars Xpress TFM Vessel Starter Set because it contains equipment that is compatible with the CEM microwave systems. The CEM microwave instruments are designed to only operate with the appropriate equipment. This equipment is necessary for the Elemental Analysis group to carry out food and feed analysis via EAM 4.7. If they use non-compatible equipment, the instrumentswould not operate and we would not be able to perform our laboratory duties according to our method. CEM Corporation is the only authorized sales agent for this requirement. Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder the mission objective of the FDA. The determination not to compete this proposed contract action solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. This is NOT a request for quotes or proposals.
