Response Due Date: July 19, 2023, by 10:00AM (EST) NOTICE OF THE INTENT TO SOLE SOURCE SYNOPSIS Network Contract Office 1, Procurement Office East on behalf of The Department of Veterans Affairs, Bedford VA Medical Center 200 Springs Road Bedford, MA 01730-1114 intends to award a firm-fixed contract with no options to CLAFLIN SERVICE COMPANY (CME, Corp) USA to provide delivery for (93) Comfortex Rest-Q Closed System Mattresses, Part# 9CLS3584RQ. The proposed procurement is for products for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. 41 U.S.C. 3304(a)(1). The North American Industry Classification System code (NAICS) for this requirement is 339113. All responsible sources that feel they should be considered qualified to provide the above-mentioned products may submit a response to this notice (by the response due date shown above) to Divianna.Mathurin@va.gov. The information provided shall include detailed (and relevant) documentation to allow the government to perform adequate market research and make a proper determination. A determination by the government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. THERE IS NO SOLICITATION AVAILABLE AT THIS TIME. REQUESTS FOR A SOLICITATION WILL NOT RECEIVE A RESPONSE. BEDFORD VA MEDICAL CENTER Nursing Comfortex Rest-Q Closed System Mattress OBJECTIVE: To procure (93) Comfortex Rest-Q Closed System Mattresses, Part# 9CLS3584RQ, for use within the VA Bedford Health Care System. SCOPE: Once the Contract has been issued all Rest-Q Mattresses shall be delivered to the following location: Bedford VAMC 200 Springs Rd Bldg. 3 Bedford, MA 01730 SERVICES: Delivery of the required quantity of mattresses SITE REQUIREMENTS: Delivery site will provide access to a loading dock for the delivery. SUPPORT/MAINTENANCE Awarded vendor should provide this facility with any and all Warranty information on this product. The contractor shall take all necessary precautions to prevent damage to any government property. The contractor shall report any damages immediately and shall be assessed current replacement costs for property damaged by the contractor unless corrective action is taken. Any damaged material (i.e., trees, shrubs, lawn/turf, curbs, gutters, sidewalks, etc.) will be replaced in a timely manner or corrected by the contractor with like materials, at no extra cost to the government, upon approval of the Contracting Officer. The contractor's employees shall wear all required personal protective equipment and visible identification at all times while on the premises of the VA property. It is the responsibility of the contractor to park in the appropriate desig nated park ing areas. Information on parking is available from the VA Police-Security Service. The VA will not invalidate or make reimbursement for parking viola tions of the con tractor under any con ditions. Smoking is prohibited inside any buildings at the VA. Cellular phones and two-way radios are not to be used within six feet of any medical equipment. Posses sion of weapons is prohibited. Enclosed containers, including tool kits, shall be sub ject to search. Violations of VA regulations may result in a citation answer able in the United States (Federal) Dis trict Court, not a local district state, or municipal court. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Contracting Activity is seeking to purchase (93) Comfortex Rest-Q Pressure Redistribution Mattress s manufactured by OEM SB AVATAR ENTERPRISES, INC. DBA: COMFORTEX (UEI: UDKCGRRZDN16), 1680 WILKE DRIVE, WINONA, MN 55987 and solely distributed by SB CLAFLIN SERVICE COMPANY (CME, Corp), (UEI: ND1BF4HPEJJ5) 1206 JEFFERSON BLVD, WARWICK, RI 02886.These Mattresses will be used in Bedford VA Medical Center s Mental Health Wards. These Comfortex Rest-Q Mattress s provide body absorbing comfort and specialty bed pressure redistribution. Ultra-soft portions of the mattress allow the bodies areas that are more prone to breakdown, to virtually float between the supportive materials of mattress. Lateral support sections of Rest-Q provide cushioning support beneath the patient along each side of the spinal column. Secure edging extends the firm perimeter material above the horizon of the sleep surface to direct patients away from the edge of the bed and a potential injury. Estimated Amount Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Comfortex 9CLS3584RQ is a US Manufactured Mattress that supports the Mental Health needs of the facility. Bedford VAMC has these in use currently throughout the facility. Comfortex is this only manufacture of this particular mattresses. Description of market research conducted and results or statement why it was not conducted: The Contracting Activity conducted its first search on VetCert using NAICS 339113 which returned 838 results, however these broad results resulted in 0 authorized distributors for this equipment. NAC search using item part number 9CLS3584RQ"" produced 1 record which was this particular product being procured through the OEM SB Comfortex under FSS contract 36F79722D0184, however they are not active in SAM. VetBiz search using NAICS 339113 along with keyword Comfortex yielded 0 organizations. GSA search using keyword Comfortex generated 1 result who were themselves OEM Comfortex under GSA contract number 36F79722D0184. SBA DSBS search using NAICS 339113 along with keyword Comfortex yielded 0 profiles. Last search was on FPDS using keyword Comfortex Mattress which returned 31 contract actions for similar mattress s from Comfortex, however none for VISN 1 nor recent with the latest being in 2007. Since this requirement s IGCE is above $25, 000, an Intent to Sole Source Notice 36C24123Q0882 was published on Contract Opportunities 07/13/2023 with a closing date of 07/19/2023. All market research leads to OEM SB Comfortex and SB CME, Corp being the only sources for this equipment, however due to the OEM (Comfortex) being inactive in SAM under UEI: UDKCGRRZDN16, this will be a sole source award to small business CME Corporation . The rule of two was not met.
