- Attachment 1: Request for Exception to Fair Opportunity Memo Format Page 1 of 6 Effective Date: 03/15/2023 Revision: 02 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Exception to Fair Opportunity Memo Acquisition Plan Action ID: 36C250-23-AP-3015 Contracting Activity: Department of Veterans Affairs, NCO 10, 24 Frank Lloyd Wright Dr., Ann Arbor, MI, 48105 in support of VISN 10 facilities (Ann Arbor, Dayton, Battle Creek, Chillicothe, Cincinnati, Columbus, Detroit, Indianapolis, Norther Indiana), Justification for Other Than Full and Open Competition for purchase request 539-23-2-048-0032. Description of Action: The proposed sole source Delivery Order against SEWP Contract Number NNG15SD34B (expiration 04/30/2025) is for a Firm-Fixed Price procurement of Howard Industries (HI) brand medical carts for nine VISN 10 facilities (Ann Arbor, Dayton, Battle Creek, Chillicothe, Cincinnati, Columbus, Detroit, Indianapolis, Northern Indiana) from Minburn Technology Group, LLC, 9716 Arnon Chapel Road, Great Falls, VA 22066. Description of Supplies or Services: The proposed action is to provide nine VISN 10 facilities with Howard medical carts, scanners and accessories. It will be a total of five hundred sixty (560) Howard Medical carts with varying specifications and configurations with onsite setup and integration, two-hundred seventy (270) additional wired Zebra scanners, seventy-five (75) additional Zebra wireless scanners, eighty-four (84) Zebra Barcode label Printers with mounting hardware, and seventy (70) additional signature pads. These items are needed to meet the needs of additional clinical areas being added to the facilities with the expansion of barcoding and specimen labeling in the new EHRM system. The current EHRM vendor utilizes barcoding in every procedural and clinical area within a VA hospital facility or outpatient setting. Estimated delivery of all equipment (including onsite setup and integration): 18 weeks ARO Accessories - 45 Days ARO HI-Care E - 8 to 10 Weeks ARO HI-Paradigm E - 10 to 12 Weeks ARO Pinnacle -14 to 16 Weeks ARO Onsite Setup and Integration - 2 Weeks Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i): \ ( ) FAR 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. ( X ) FAR 16.505(b)(2)(i)(B): Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. ( ) FAR 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. ( ) FAR 16.505(b)(2)(i)(D): It is necessary to place an order to satisfy a minimum guarantee. ( ) FAR 16.505(b)(2)(i)(E): For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source . The statutory authority permitting an exception to fair opportunity for this action is 38 U.S.C. 8127(c), known as the Veterans First Contracting Program which provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. The BCMA carts and associated peripherals identified in Section 3 are already in use throughout every VISN 10 hospital and outpatient clinic. All patient care areas use this system to ensure each veteran is receiving the appropriate drugs and that all passing of medication is accurately documented and recorded back to VistA/CPRS, then the new EHRM. With the new EHRM, barcoding will be utilized in every patient care area for scanning of medications, specimens, wristband labels, surgery infusions and all procedural areas. VISN 10 is widely standardized on Howard medical carts and requires these additional carts to be compatible with existing inventory, providing interchangeable parts and communication and integration with the existing, VA-approved Power Manager, Med Manager and Power Display Software. Due to recent efforts to transition VISN 10 to standardized devices 1,176 (89%) of the devices are currently Howard Medical Carts. VISN 10 will meet the goal of 100% standardization to Howard Medical Carts with the completion of this purchase. Standardization will ensure continuity and consistency of operations and will eliminate the additional training, servicing and procurement costs associated with procuring carts from another manufacturer. Currently, Minburn Technology Group, LLC, is the only authorized distributor and source for the procurement of these carts. Minburn was responsible for the onsite set-up and integration of the carts under the Phase I and Phase II orders for the Howard carts. Minburn has intimate knowledge and familiarity with the existing systems, configuration and needs of the VISN 10 medical centers to ensure that the work is completed, and equipment is integrated and functioning properly with no delays and as effectively and efficiently as practicable. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b)(2)(D), this action will be synopsized at award on SAM.gov and the justification will be made publicly available. Actions to Increase Competition: Should the Government have a future need for this requirement, the Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. Market Research: VetCert was queried under NAICS 541519 and 3277 concerns were found. Legacy VIP was queried under NAICS 541519 and Howard and 1 concern was found, Minburn Technology Group, LLC. The sole source vendor, Minburn Technology Group, LLC was also found in VetCert. DSBS was searched under NAICS 541519 and keyword Howard and no results were found. GSA/NAC/SCMS were all searched with no results. NAICS 541519 is not on the Non-Manufacturer Rule (NMR) Class Waiver list. NMR findings resulted in the manufacturer, Howard Industries, a large business, confirming that Minburn Technology Group, LLC is the only authorized distributor and vendor that sells to the VA. The manufacturer does not sell direct. This will be a sole source to Minburn Technology Group, LLC, a SDVOSB. FITARA approval was completed. Howard carts are manufactured in the US. The IT items are covered under the BAA exception at FAR 25.103(e). Since the estimated dollar value of each SEWP contract exceeds the established Trade Agreements Act (TAA) threshold, the TAA is applicable to all SEWP contracts and only U.S.-made or designated country end products shall be purchased under SEWP contracts unless an exception exists and is documented by the Contracting Officer as noted in FAR 25.401. However, the TAA is not applicable due to the exception at 25.401(a)(5) as this is a sole source acquisition. The BAA is applicable to the domestic manufactured products and the BAA exception at FAR 25.103(e) applies to the IT commercial item products that are not made in the US. The only way to procure is through Minburn Technology Group, LLC through SEWP contract NNG15SD34B. Minburn Technology Group, LLC confirmed all requested items are on their SEWP contract. The VA Rule of Two cannot be met, nor can the SBA Rule of Two be met. Other Facts: Standardization provides a benefit to each VA, will ensure continuity and consistency of operations, and will eliminate patient safety risks. Thousands of clinical settings have since adopted the barcode medication administration (BCMA) program into the daily workflows since it was first implemented in 1985. On average there is an estimated 44,000-98,000 deaths each year caused by medication errors and poor documentation. The use of medication carts to distribute medications while documenting at the patient bedside is the key reason for the purchase of these medical carts. Barcode medication administration involves the scanning of a barcode on the medication package, the patient armband, and the ID of the clinical staff giving the medication. The collected data is cross-checked against a database of allergies, dose warnings, and interactions to prevent medication dose errors. At the heart of any medication administration is the 5 Rights : The right patient, the right drug, the right dose, the right route, and time. Additionally, VISN 10 is purchasing Zebra scanners and printers to resolve another huge patient safety risk the misidentification of patient specimen and collections. Several VISN 10 sites have been cited for mishandling of patient specimen samples and mislabeling all before getting to the lab for analysis. With the purchase of these carts, scanners and printers, we plan to alleviate all those patient safety risks by doing bedside specimen collection and bedside medication administration.
