Description: PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS INTRODUCTION- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.� The National Institutes of Health, National Institute of Child Health and Development (NICHD), in support of the work of the National Institute of Diabetes, Digestive, and Kidney Disease (NIDDK), intends to award a purchase order without providing for full and open competition (Including brand-name) Zayo Group LLC, 1805 29th Street, Ste 2050, Boulder, CO 80301-1067 to procure Dark Fiber Services.� NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE - The intended procurement is classified under NAICS code 517111with a Size Standard 1500. REGULATORY AUTHORITY - The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Regulation (FAR) Circular (FAC) 2023-04 effective 06/02/2023.� This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000) and FAR Subpart 12- Acquisition of Commercial Items.� STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold.� Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. DESCRIPTION OF REQUIREMENT The objective of this requirement is to lease Dark Fiber WAN circuit(s) which provide network connectivity to support IT operations for additional Phoenix NIDDK users who will be occupied Building Guadalupe, 8625 S. Avenida del Yaqui Temple AZ.� ��The purchase order term will be for a Base + 3 Option years: Base Period: �� 08/15/23 � 08/14/24 Option Period One: �� 08/15/24 � 08/14/25 Option Period Two: �� 08/15/25 � 08/14/26 Option Period Three: �� 08/15/26 � 08/14/27 PLACE OF PERFORMANCE: 445 N. 5th Street, Phoenix,AZ,85004 The NIDDK has two research facilities in Phoenix, Arizona area that require high-speed WAN circuit to transfer their data back and forth. The existing WAN circuits are too costly and do not meet the network bandwidth demands. We are seeking WAN circuit connectivity through dark fiber infrastructure which will meet our network bandwidth requirement now and well into the future. NIDDK has placed a communication pull box at the Southeast corner of property and now has a conduit path, from that point into telco room within building. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-� NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10�Market Research.� Only one source is available: Per FAR 13.106-1(b)(1) the Contracting Officer has determined that Zayo is the only vendor that can provide the Dark Fiber services required by the NIH/NIDDK.� The following specifications are the only ones that can be met by Zayo: Dark Fiber Point to Point, Fiber Count: 2 CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provided feedback to respondents with respect to any information submitted.� Responses to this notice shall contain sufficient information to establish the interested parties� bona-fide capabilities for fulfilling the requirement, unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Vendor/Contractor�s (UEI) the Unique Entity ID from SAM.gov is now the authoritative identifier for those doing business with the federal government. The DUNS Number is no longer valid for federal award identification, the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.� In accordance with 36CFR Part 1194, all purchases for Electronic/Information Technology (EIT) must include a list of accessibility standards for the requirement. �� Persons Without Vision. Where a visual mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that does not require user vision. �� Persons With Limited Vision. Where a visual mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that enables users to make use of limited vision. �� Persons Without Perception of Color. Where a visual mode of operation is provided, NIDDK/CTB shall provide at least one visual mode of operation that does not require user perception of color. �� Persons Without Hearing. Where an audible mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that does not require user hearing. �� Persons With Limited Hearing. Where an audible mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that enables users to make use of limited hearing. �� Persons Without Speech. Where speech is used for input, control, or operation, NIDDK/CTB shall provide at least one mode of operation that does not require user speech. �� Persons With Limited Manipulation. Where a manual mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that does not require fine motor control or simultaneous manual operations. �� Persons With Limited Reach and Strength. Where a manual mode of operation is provided, NIDDK/CTB shall provide at least one mode of operation that is operable with limited reach and limited strength. �� Persons With Limited Language, Cognitive, and Learning Abilities. NIDDK/CTB shall provide features making its use by individuals with limited cognitive, language, and learning abilities simpler and easier. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
