- NOTICE OF INTENT TO SOLE SOURCE The Defense Health Agency (DHA) intends to award a sole source contract under the authority of 8.405-6(a)(1)(B) - Federal Supply Schedule, only one source is capable of providing the supplies or services to INO Therapeutics, LLC, 1425 US Route 206, Bedminster, NJ 07921 for INO Therapy Services that consists of delivery of gases, exchange of machines, preventive maintenance, and cylinder/machine pick up. Vendor shall be an Original Equipment Manufacturer (OEM) authorized maintenance contractor for the proposed equipment/systems such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. INO Therapeutics LLC, is the only vendor authorized to provide and service INOmax. INO Therapeutics requires the exclusive use of gases they provide, and OEM certified technicians only to perform maintenance and service. The inhaled nitric oxide delivery unit known as the (INOmax) is uniquely produced by INO Therapeutic, LLC for the specific purpose of nitric inhalation. Use of the INOmax machine requires the use of OEM that can provide the required medical gas of this product directly affecting patient care and the only authorized technicians to provide required maintenance and services. The OEM (INO Therapeutics) does not authorize any third-party vendors to conduct maintenance, warranty, or service work on any of their products. This notice of intent is not a request for competitive proposals and no solicitation document exists for the requirement; however, if a vendor challenges the basis for this requirement, please submit a capability statement that includes sufficient detail and with convincing evidence that clearly demonstrates the capability to submit a product meeting the minimum requirements specified above. Capability statements shall not exceed 5 (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source procurement. Capability statements are due by 4:00 P.M. EST, 17 August 2023. Capability statements shall be submitted by email ONLY as a Microsoft Word or Adobe PDF attachment to Christine Russman, christine.l.russman.civ@health.gov. No phone calls will be accepted.
