- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Exception to Fair Opportunity Memo Acquisition Plan Action ID: 36C262-23-AP-7396 1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22, Greater Los Angeles VA Healthcare System. 2237: 691-23-3-4099-0055 2. Description of Action: The proposed sole source task order against Government Wide Acquisition Contract (GWAC) HTC71117D003 is for two (2) months firm-fixed price (FFP) services for package delivery services for the Greater Los Angeles VA Healthcare System. 3. Description of Supplies or Services: The proposed action is to provide domestic package delivery services via United Postal Service to the Greater Los Angeles VA Healthcare System. United States Postal Service shall provide small package delivery services, United States domestic express, and ground small package delivery services. The total estimated value of the proposed action is $72,050.00. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i): FAR 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. 5. Rationale Supporting Use of Authority Cited Above: The Greater Los Angeles VA Healthcare system requires the utilization of small package delivery services from United Postal Service. Failure to continue services would cause logistic hardship for the Greater Los Angeles Healthcare System. Additionally, in accordance with OMB BIC Mandatory Use Memo M-17-29, all agencies shall utilize the mandatory contract sourcing solution for package delivery services utilizing the General Services Administration Acquisition Gateway. 6. Efforts to Obtain Competition: Market research was conducted and described later within this document. The maximum level of efforts revealed that there is a mandatory source for small package delivery services for the United States Government. Due to the urgent needs of the facility, this requirement shall be procured in accordance with FAR 16.505(b)(2)(i)(A). 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. 8. Market Research: Market research was conducted by reviewing the OMB BIC Mandatory Source memorandum. Guidance provided from the memorandum directed the use of the Government mandatory source Next Generation Delivery Service 2 multiple award contract. 9. Other Facts: The Greater Los Angeles VA Healthcare System utilizes multiple vendors within the Next Generation Delivery Service multiple award contract to provide continual domestic small package delivery services. Both contractors providing domestic small package delivery services are utilized at the facility. Failure to continue services with United Postal Service would cause significant logistic delays and harm the Greater Los Angeles VA Healthcare system if not procured. 10.
