Unison Marketplace has developed an online, anonymous, browser based application to conduct the reverse auction. A Seller may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. The Offeror shall not complete the representation in paragraph(d)(2) of this provision if the Offeror has represented that it ""does not use covered telecommunications equipment orservices, or any equipment, system, or service that uses covered telecommunications equipment or services"" inparagraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.(a) Definitions. If the Offeror has responded ""will"" in therepresentation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of theoffer:(i) For covered equipment--(A) The entity that produced the covered telecommunications equipment (include entity name, unique entityidentifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, ifknown);(B) A description of all covered telecommunications equipment offered (include brand; model number, such asOEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant todetermining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.(ii) For covered services--(A) If the service is related to item maintenance: A description of all covered telecommunications services offered(include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, orwholesaler number; and item description, as applicable); or(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; andexplanation of the proposed use of covered telecommunications services and any factors relevant to determining ifsuch use would be permissible under the prohibition in paragraph (b)(1) of this provision.(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded ""does"" in therepresentation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of theoffer:(i) For covered equipment--(A) The entity that produced the covered telecommunications equipment (include entity name, unique entityidentifier, CAGE code, and whether the entity was the OEM or a distributor, if known);(B) A description of all covered telecommunications equipment offered (include brand; model number, such asOEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant todetermining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.(ii) For covered services--(A) If the service is related to item maintenance: A description of all covered telecommunications services offered(include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, orwholesaler number; and item description, as applicable); or(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed useof covered telecommunications services and any factors relevant to determining if such use would be permissibleunder the prohibition in paragraph (b)(2) of this provision.(End of provision) The Government will award a contract resulting from this solicitation to the responsible offeror whose offerconforming to the solicitation will be most advantageous to the Government, price and other factors considered. Thefollowing factors shall be used to evaluate offers:** Basis for Award:The request for quotation uses streamlined acquisition procedures pursuant to FAR Part 12 and FAR Part 13 asauthorized. The Government intends to award a firm fixed price contract resulting from competitive quotes receivedin response to this solicitation. The quote will be evaluated for a fair and reasonable price. All contractors arereviewed for responsibility IAW FAR 9 and for US Government past performance.The award decision will be based on price and other factors, IAW FAR 13, where factors other than price are valuedmore than the low price alone in order for the Government to obtain the best value. The evaluation factors are asfollows:Evaluation Factors for Award.FACTOR 1: Relevant Past ExperienceThe contractor submits with their quote a maximum of two (2) relevant past experiences providing AMPmaintenance services. The depth and breadth of the experience, and quantity up to themaximum of two, are evaluated using the following scale: Pass and Fail.FACTOR 2: Pricea. The total evaluated price shall be the sum of all CLIN/ELIN prices listed in the schedule. Thisamount willbe the total evaluated price.b. Each offerors proposed price will be evaluated to determine whether it is fair and reasonable as perFAR 13.106-3. Offerors are cautioned that an unrealistically low price, or unbalanced pricing ofline items, as proposed initially or subsequently, may be a ground for eliminating a quote fromconsideration, either on the basis that the offeror does not understand the required services, orhe/she has made an imprudent offer.d. All prices will be assessed by the USG for being fair, reasonable, and realistic.(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offerorwithin the time for acceptance specified in the offer, shall result in a binding contract without further action by eitherparty. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whetheror not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.(End of provision) OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS ANDCOMMERCIAL SERVICES (DEC 2022) ALTERNATE I (OCT 2014)The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.(a) Definitions.
