- This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6-Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2023-04 Effective 06/02/2023. �� The synopsis/solicitation number: W91ZLK-23-Q-0051. Description of Requirement: Adobe Stock Library Content License Agreement. Defense Centers for Public Health - Aberdeen (DCPH-A) Defense Health Agency (DHA), MEDCOM, Public Health Communication requires the purchase of Brand Name Adobe Stock library subscription license to acquire royalty free stock imagery, photography, vector art, graphics, video, audio, and templates for use in health information products and visual communication and design. The DCPH-A is requesting stock imagery and audio for communicating the public health mission of �DHA. The Contractor shall provide Adobe Content License Agreement for digital imagery; photography, vector art, graphics, video, and audio as defined in this PWS. The Contractor shall provide access to digital photography, vector art, graphics, video and audio and a license to use the imagery which must include the following: Contractor shall grant Defense Health Agency, ARMY MEDCOM, and DCPH-A a perpetual, non-exclusive, non-transferable, non-sub licensable, worldwide right to display, use, reproduce, publish, alter in an unlimited number of projects, in whole or in part, via any medium and by whatever means, the content for any purpose within the Permitted Use or Uses allowed by the Contractor. Use in projects without limitations to audience or budget, primary distribution to the entire Army and Department of Defense, to include family members, retirees and civilian employees. All copyright and other intellectual property rights relating to the content, are retained by the supplier and or copyright holder of the content. Period Of Performance. Base year plus two option years as listed below: �Base period 09/20/2023 � 09/19/2024 Option period 1 09/20/2024 � 09/19/2025 Option period 2 09/20/2025 � 09/19/2026 Specific Tasks / Requirements: Objective 1: Key Task 1 � Provide a minimum of 30,000 credits a year to download premium content. Key Task 2 � No daily limit on number of files to be downloaded. Key Task 3 � Provide Enterprise Solution with unlimited users. Key Task 4 � Provide ability to print runs up to 500,000 with no aggregated limit. Key Task 5 - Use imagery for healthcare-related print and digital products �For Specific information please refer to the attached Purchase Description Document. This procurement is being conducted using the Simplified Acquisition Procedures authorized in FAR Part 13 Simplified Procedures for Commercial Items. This requirement is being solicited under NAICS Code: 513210. The Government contemplates an award of a Firm-Fixed Price (FFP) type contract that will be evaluated based on Lowest Priced offer that meets all the requirement listed in the performance work statement (PWS). �� Proposals shall be submitted as price and technical: Proposal: Please submit detailed price proposal in accordance with the performance work statement (PWS) document. The Price proposal shall clearly identify the firm fixed price unit prices. Offeror's cost/price proposals will be evaluated based on the applicable criteria in FAR 15.404-1. Offerors are encouraged to submit any other price or financial information that may clarify evaluation of the Price Proposal; however, superfluous, or elaborate documents are discouraged. Partial quotes will not be evaluated. Technical acceptability will be based on a proposal that meets all the requirements stated in the performance work statement (PWS). Technical proposal shall be ��rated as Acceptable, or Unacceptable. To receive consideration for award, Contractor shall achieve technically acceptable rating on all requirements listed in the PWS. Award without Discussions: In accordance with FAR 52.212-l (g), the Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). Therefore, the Offeror's initial proposal shall contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. Determination of Responsibility: In accordance with FAR 9.103, contracts will be placed only with Contractors that the Contracting Officer determines to be responsible. For Prospective offerors, to qualify as sources for this acquisition, offerors must be able to demonstrate that they meet standards of responsibility set forth in FAR 9.104. No award shall be made to an Offeror who has been determined non-responsible by the Contracting Officer. Instructions to Offerors: Contracts shall be awarded in the following order of priority when two or more low bids are equal in all respects: Small business Developmental Program 8(a) active participant. Small business socioeconomic contracting programs participants. Other Small business concerns. The provision at FAR 52.212-2 - Evaluation -- Commercial Items, applies to this acquisition. The technical evaluation will be a determination based on information furnished by the vendor in the submitted proposal. The Government is not responsible for locating or securing any information which is not identified in the offer. The Government reserves the right to make an award without discussions. By submitting a quote, the Contractor agrees to the notations identified in the performance work statement (PWS). � All quotations from responsible sources will be fully considered. Vendors who are not registered in the System for Award Management (SAM), https://sam.gov/ database prior to award will not be considered. Vendors may register with SAM online at the website link provided. The Government reserves the right to cancel the referenced solicitation if deemed to be in its best interest.
