- Private Equity, Venture Capital, and Non-Depository Financial Institution Data Notice ID: Q000012 -� Amendment 00001: The purpose of this solicitation amendment is to answer questions received by industry. �Please see below: 1. You do not need us to take any action with regards to the Vendor Past Performance document on the website. Past Performance falls under Volume II and will be evaluated as detailed within the solicitation. 2. Will the format that �COMPANY-X� used for responding to the earlier RFQ in 2022 work for your purposes. It is advised to follow the instructions, and evaluation criteria, presented within the solicitation to avoid responding with an incomplete quote. 3. We would like to know if this is a brand-new contract OR if there is (was) an incumbent performing these services. �If not brand new, could you please provide the current / previous contract number. There is no incumbent for this action. �This is a new procurement. 4. We have comments to the RFQ. �Many of the clauses in the document would not apply to us given the nature of our business and what we are providing in the form of data to OCC. �Many of these items would be covered in our Content License Agreement as well. �Therefore, if we have comments/redlines to the RFQ, then is it best to submit that redlined RFQ in Volume IV as part of our submission? Submission with Volume IV is acceptable. �Any negotiations entered into, in response to federal regulated contract clauses and provisions, will require our legal department. 5. If awarded the contract, would we negotiate terms on the RFQ from that point forward or add them as line items to our Content License Agreement? Negotiations need to occur prior to contract award.� Contract clauses are generally non-negotiable as they are required by federal law. �Same for provisions, which only apply during the solicitation phase and removed prior to award. �As per Section 6.0, under �Instructions, Evaluation, and Basis for Award,� the solicitation states, �The Government intends to award without allowing quote revisions (i.e., material changes to quotes) but reserves the right to seek revisions of quotes should it be in the best interest of the Government.�� Do not anticipate that negotiations will occur, and revisions will be allowed. ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------ This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. �This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This solicitation is issued as a request for quotation (RFQ), and the procurement is being conducted using the procedures found in FAR Subpart 13.5 �Simplified Procedures for Certain Commercial Products and Commercial Services.�� This solicitation incorporates provisions and clauses in effect through Federal Acquisition Circular 2023-04, June 2, 2023. �This acquisition is being solicited as un unrestricted procurement (i.e., is NOT set aside for small business). �The NAICS code for this acquisition is 519290, �Web Search Portals and All Other Information Services,� and the small business size standard is 1,000 employees.� The Product Service Code associated with the aforementioned NAICS is B507, �Special Studies/Analysis- Economic.� �FAR provision 52.212-1, Instructions to Offerors � Commercial Products and Commercial Services applies to this solicitation with addendum as found in this combined synopsis/solicitation (see addendum to 52.212-1).� Line-item numbers and items, descriptions, quantities, units of measure, and options can be found in this document. �Quoters must either include a copy of the representations and certifications found in FAR provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services or have submitted them via the System for Award Management (SAM) website, SAM.gov, in accordance with provision 52.212-3 (attached); even if submitted in SAM.gov, Quoters must complete paragraph �b� of the provision if it applies. �Quoters must separately complete the representation(s) in FAR provision 52.204-24 and submit them with their quote (when they apply) as these representations are not found in SAM.gov.� FAR clause 52.212-4, Contract Terms and Conditions � Commercial Products and Commercial Services applies to this acquisition with any addendum noted in this document.� FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Products and Commercial Services is applicable to this RFQ (see clauses section of this RFQ). �This document may contain additional contract requirements or terms and conditions determined by the contracting officer to be necessary for this acquisition and consistent with commercial practices. �All quotations submitted for this solicitation are due no later than 25 August 2023 at 12:00 PM (Noon), Eastern Time.
