VHAPG Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >SAT 36C242-23-AP-2549 Effective Date: 02/01/2022 Page 1 of 5 LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C242-23-AP-2549 Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 02, located at 2875 Union Rd, Cheektowaga, NY 14227, in support of VISN 02 VA Health Care System at 260 Calkins Rd, Rochester , NY 14623. 2237: 528-23-3-6403-0054 Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). Order against: FSS Contract Number: 36F79721D0168 Name of Proposed Contractor: Olympus America , Inc Street Address: 3500 Corporate Pkwy City, State, Zip: Center Valley, PA 18034-0610 Phone: 484-896-5838 Description of Supplies or Services: The estimated value of the proposed action is $484,295.40 The total estimated value of the base and 4 (four) options is $484,295.40. The base year period of performance is 09-01-2023 to 08-31-2024. Four subsequent option years will be included for a total possible period of performance from 09-01-2024 to 08-31-2028. The ROPC Urology Department requires a lease of cystoscopes with cameras and associated equipment to do diagnostic urological procedures. Types of scopes and accessories required include: Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; VISN 2 Leadership, in conjunction with a national commodity standardization initiative (for scopes), made the decision to standardize scopes into our tertiary care facilities. The decision to standardize around the Olympus endoscopes was based on the following: 1.) The preponderance of scopes in use at the ROPC has been made with Olympus; 2.) A significant portion of those in use were within their useful life; and 3.) Continued utilization of the scopes that have been predominantly in use maintain the standard of care, minimize patient risk associated with large scale changes in clinical practices associated with those scopes, and reduce training and transition costs associated with use of the same manufacturer. Attempting to substitute alternatives would cause issues with standardization, which could lead to significant patient risk. Clinician familiarity with a given scope dramatically influences the quality of the procedure, its outcome, and the patient experience. Based upon the national endoscope standardization it is in the best interest of the government to continue with already existing Olympus infrastructure. This equipment for the cystoscopes will be seamlessly compatible in form, fit and function. FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. FAR 8.405-6(b): Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Lease of Olympus Scopes is only available directly through Olympus. A lease has been determined to be the in the VA s best interest in order to have the flexibility to trade them in at the end of the order performance period and lease the newest model(s) on the market at that time. Leasing newer-model endoscopes ensures that the standard of care is maintained consistently, efficiently and effectively managing lifecycle maintenance costs, and simplifying user training due to product familiarity. This lease arrangement minimizes patient risk in addition to maintaining the highest levels of scope availability and operational readiness. Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. A search conducted on Vet Biz using the key word Olympus using NAICS code 339112 identified one SDVOSB, Alliant Enterprises, LLC that could potentially meet the requirements of this procurement. However, a review of the VIP profile confirmed that they could not meet the leasing requirements of this procurement. A search was conducted on GSA using key words Olympus using NAICS code 339112. It was identified that Olympus has a current FSS contract #36F79721D0138 that contract expires 12/31/2026. A search was conducted on SBA using key words Olympus using NAICS code of 339112. Two (2) vendors were identified, and their capabilities were reviewed, neither offer endoscopes for lease. The capabilities include repair/reprocessing services, ancillary supplies, or medical scopes. An intent to sole source was posted on 07/13/2023 to 07/17/2023 which resulted in zero responses. The results of Market Research for past and ongoing procurements were reviewed. Currently, there is an active Olympus Lease contract (36C24220P1245, 02/21/2020 02/20/2025) in the amount of 361,042.20, for the Buffalo VA Medical Center. Any Other Facts Supporting the Justification: The ROPC Urology Unit currently possess compatible equipment within its inventory that will only work with the requested scopes. Staff is trained in the use of all Olympus equipment on the proposed lease and using any other scopes besides Olympus would require clinical staffs throughout the hospital to learn how to use two different brands of cystoscopes and video processors which is a patient safety risk. As this equipment utilizes proprietary hardware and software, only Olympus America Inc. can meet the needs of the facility.
