- This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract and is not a request for competitive quotes/proposals. The U.S. Department of Housing and Urban Development (HUD) on behalf of the Office of Fair Housing and Equal Opportunity (FHEO), intends to negotiate with Mark J. Mazz, AIA, LLC of Hyattsville, MD on a sole source basis under the authority of FAR Subpart 13.106-1(b) � Only one responsible source and no other supplies or services will satisfy agency requirements, to procure Accessibility Compliance Consulting Services to support the review and litigation of Voluntary Compliance Agreements (VCAs). The U.S. Department of Housing and Urban Development intends to issue a one year (one 12-month base year); firm fixed price; sole source award contract to Mark J. Mazz, AIA, LLC, a small business. The NAICS Code is 541310 - Architectural Services - primarily to prepare expert analysis, comment, revision and reports on accessibility-related documents and other technical information for the purpose of investigation, monitoring, and implementation of the VCAs and protentional litigation matters. The architect shall be knowledgeable regarding the federal accessibility standards under Section 504 of the Rehabilitation Act, the Americans with Disabilities Act, and the Fair Housing Act, who qualify as an expert in litigation on behalf of the United States government under the Daubert standard and related authorities, and who can meaningfully discern and testify to the differences between federal and state accessibility standards, and who may have knowledge of accessibility violations likely for properties at issue in the subject litigation. The architect will serve as a subject matter expert and consultant regarding the litigation matters. The primary objective is to review, analyze, comment, revise and prepare reports and/or provide architectural advice and expertise relating to deliverables produced by the District of Columbia Housing Authority (DCHA) and/or accessibility consultants under the VCAs or in relation to the other potential litigation matters involving access to facilities, including architectural survey protocols, survey forms and checklists, applicable accessibility standards, survey reports, certifications of compliance with applicable accessibility standards, and other technical documents related to the monitoring and implementation of the various matters. Reports may require onsite accessibility surveying of properties located in the District of Columbia to assess compliance with applicable accessibility standards. Expert advice may require the comparison of architectural standards and codes to deliverables produced by the DCHA and/or accessibility consultants under the VCAs and other referenced matters and recommendations suitable for use by HUD�s regulatory team to produce a final version of the proposed standard and associated commentary. Interested sources who submit data are responsible for appropriately marking information if it is proprietary in nature. The Government shall not reimburse interested sources for any information provided. No requests for capability briefings will be honored. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. This is NOT a request for quotes or proposals. Interested parties that believe they could satisfy the requirements listed above for the Office of Fair Housing and Equal Opportunity may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
