Notice Type: Notice of Contract Action � 15k Diesel Forklift Rental 2023-2024 Justification, Statutory Authority: FAR 13.501(a) � 41 USC 1901- Only one responsible source and no other supplies or services will satisfy agency requirements. Synopsis: This is a Sole Source synopsis published for informational purposes only. The United States Air Force Test Center/Directorate of Contracting (AFTC/PZZG), Edwards AFB, CA intends to issue a sole source contract to Federal Contracts Corp. for their 15k Diesel Forklift Rental 2023-2024 requirement. The contract will be executed by means of other than full and open competition, due to the need to maintain commonality, interoperability and compatibility with the current infrastructure located at Edwards AFB and used by the 419 FLTS. In order to comply with FAR 5.207(c)(15), the reason for lack of competition is as follows: FAR 8.405-6 requires an ordering activity to justify its actions when restricting consideration of schedule contractors to fewer than required in FAR 8.405-1. FAR 8.405-6(b)(1). ""These items are peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer."" This requirement is a follow-on to both FA9302-21-F-0040 and FA9302-22-F-0050. In order to continue without a work stoppage and avoid the additional cost to the government to change vendors, it is in the best interest to the government to continue the service with the incumbent. Edwards AFB has a limited number of 15k forklifts in which they are able to loan for the program use. There are no 15k diesel forklifts available in the LRS fleet to loan the Mission Partner. The SUU-1760 Program is a high visibility program and the 15k forklift support will increase our capability to accomplish accelerated testing. The award must proceed as a sole source to the current awardee to maintain congruency and avoid additional costs to the government that would result from changing vendors. The previous contract, FA9302-22-F-0050, included a Pick-Up and Delivery fee which would be an additional unnecessary expense that would result from changing vendors whereas continuity of service would not require forklift transport/delivery fees. Due to these factors, no other brand source can be found and selecting different brands for this specific requirement will cost the government both money and lost time. Federal Contracts Corp. is the sole vendor considered technically acceptable to meet the government requirement for the subject acquisition. As a result of this market research, it is in the best interest of the government to move forward with a sole source acquisition to Federal Contracts Corp. in order to fulfill the needs of this requirement.
