Description
THIS IS A PRESOLICIATION NOTICE OF A SET-ASIDE FOR SDVOSB BB Replace Air Handling Unit ED-203 This procurement is set-aside based on an order of priority as established in 38 U.S.C. 8127. SET ASIDE FOR SERVICE DISABLE VETERANS OWNED SMALL BUSINESS(SDVOSB): This solicitation is being issued as a Set aside for Service-Disabled Veteran Owned Small Business. The NAICS code for this procurement is 238220 Plumbing, Heating, and Air-Conditioning Contractors with a size standard of $19M. The VAAR 836.204 magnitude of this project is between $1,000,000.00 and $2,000,000.00. This project will be Service-Disabled Veteran Owned Small Business set-aside, as stated above. This is a pre-solicitation notice only. No contract shall be awarded from this pre-solicitation notice. The Department of Veterans Affairs, Network Contracting Office 08 (NCO 08) project # 673-21-151 BB Replace Air Handling Unit ED-203, at the James A Haley Veterans Affairs Medical Center, located at 13000 Bruce B Downs Blvd, Tampa, FL 33612, RFP #. 36C24824R0011. Contractor shall completely prepare site for building operations, including demolition and removal of existing structures, and furnish labor and materials and perform work for Replace Air Handling Unit ED-203 at the James A. Haley VA Hospital, located at 13000 Bruce B. Downs Boulevard, Tampa, Florida as required by the drawings and specifications included in this acquisition package. (See Attached SOW and documents) This project will be 100% set-aside for Service-Disabled Veteran-Owned Small Businesses, The Contracting Officer for this project will be Kenneth Caryer. The Contract Specialist is David Hernandez and he can be contacted at (813) 893-3904 or email at david.hernandez1@va.gov Important Notice: Apparent successful offerors that claim SDVOSB or VOSB status must apply for and receive certification from the SBA Veteran Small Business Certification Program (also referred to informally by the SBA as VetCert ), 13 CFR 121, 125, and 128, and VAAR subpart 819.70 by submission of documentation of Veteran status, ownership, and control enough to establish appropriate status, the prospective contractor represents that it is an eligible and certified SDVOSB or VOSB. Failure VERIFIED by the Veteran Small Business Certification (VetCert) database at the time of offer submission and contract, award will result in the offerors proposal being deemed non-compliant. As prescribed in 819.7009, insert the following clause: 852.219-73 VA NOTICE OF TOTAL SET-ASIDE FOR CERTIFIED SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESSES (NOV 2022) (JAN 2023) (DEVIATION) (a) Definition. For the Department of Veterans Affairs, Service-disabled Veteran-owned small business concern or SDVSOB: (1) Means a small business concern: (i) Not less than 51 percent of which is owned by one or more service-disabled Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.201, Surviving Spouse definition); (ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran; (iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document; (iv) The business has been certified for ownership and control pursuant to 38 U.S.C. 8127, 13 CFR 128, and is listed as certified in the SBA certification database at https://veterans.certify.sba.gov/; and (v) The business agrees to comply with VAAR subpart 819.70 and Small Business Administration (SBA) regulations regarding small business size, government contracting, and the Veterans Small Business Certification Program at 13 CFR part 121,125, and 128. Including the nonmanufacturer rule and limitations on subcontracting (LOS) requirements in 13 CFR 121.406 and 125.6, provided that any reference therein to a service-disabled veteran owned small business concern (SDVO SBC), is to be construed to apply to a VetCert - certify SDVOSB. The nonmanufacturer rule and the limitations on subcontracting apply to all SDVOSB and VOSB set asides and sole source contracts. (2) Service-disabled Veteran means a Veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). (b) General. (1) Offers are solicited only from eligible service disabled Veteran-owned small business concerns. Only VetCert-listed service-disabled Veteran owned small business concerns (SDVOSBs) may submit offers in response to this solicitation. Offers received from concerns that are not either VetCert-listed service-disabled Veteran-owned small business concerns, (2) Any award resulting from this solicitation shall be made to a VetCert-listed service-disabled Veteran-owned small business concern, that meets the size standard for the applicable NAICS code. (c) Representation. By submitting an offer, the prospective contractor represents that it is an eligible SDVOSB as defined in this clause, 38 CFR part 74, and VAAR subpart 819.70. Pursuant to 38 U.S.C. 8127(e), only VetCert -listed SDVOSBs are considered eligible. Therefore, any reference in 13 CFR part 121 and 125 to a service-disabled Veteran-owned small business concern (SDVO SBC), is to be construed to apply to a VetCert -listed SDVOSB s and VOSB s and only such concern(s) qualify as similarly situated. The offeror must also be eligible at the time of award. (d) Agreement. When awarded a contract (see FAR 2.101, Definitions), including orders under multiple-award contracts, or a subcontract, an SDVOSB agrees that in the performance of the contract, the SDVOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size and government contracting programs at 13 CFR part 121 and 125, including the nonmanufacturer rule and limitations on subcontracting requirements in 13 CFR part 121.406 and 125.6, provided that for purposes of the limitations on subcontracting, only VetCert -listed SDVOSBs shall be considered eligible and/or similarly situated (i.e., a firm that has the same small business program status as the prime contractor). An independent contractor shall be considered a subcontractor. An otherwise eligible firm further agrees to the following: (1) Services. In the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs, listed in the SBA certification database. (2) Supplies or products. (i) In the case of a contract for supplies or products (other than from a nonmanufacturer of such supplies), it will not pay more than 50% of the amount paid by the government to it to firms that are not certified SDVOSBs, listed in the SBA certification database. (ii) In the case of a contract for supplies from a nonmanufacturer, it will supply the product of a domestic small business manufacturer or processor unless a waiver is described in 13 CFR 121.406(b)(5) is granted. d. Refer to 13 CFR125.6(a)(2)(ii) for guidance pertaining to multiple item procurements. (3) General construction. In the case of a contract for general construction, it will not pay more than 85% of the amount paid by the government to it to firms that are not certified SDVOSBs, listed in the SBA certification database. (4) Special trade contractors. In the case of a contract for special trade contractors, it will not pay more than 75% of the amount paid by the government to it to firms that are not certified SDVOSBs, listed in the SBA certification database. (5) Subcontracting. An SDVOSB subcontractor must meet the NAICS size standard assigned by the prime contractor and be certified and listed in the SBA certification database to count as similarly situated. Any work that a first tier SDVOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, the cost of materials is excluded and not considered to be subcontracted. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the portion of the contract with the preponderance of the expenditure upon which the assigned NAICS is based. For information and more specific requirements, refer to 13 CFR 125.6. (e) Joint ventures. A joint venture may be considered an SDVOSB if the joint venture complies with the requirements in 13 CFR 128.402 and the managing joint venture partner makes the representations under paragraph (c) of this clause. A joint venture agrees that, in the performance of the contract, the applicable percentage specified in paragraph (d) of this clause will be performed by the aggregate of the joint venture participants. (f) Precedence. The VA Veterans First Contracting Program, as defined in VAAR 802.101, subpart 819.70, and this clause, takes precedence over any inconsistencies between the requirements of the SBA Veteran Small Business Certification Program and the VA Veterans First Contracting Program. (End of clause). The anticipated posting date of the solicitation on SAM.gov | Home will be on or about November 10, 2023. Contractors must be registered in the SAM.gov | Home portal prior to contract award, during contract period of performance and must continue to remain registered through the final invoice payment. SDVOSB and VOSB concerns must be registered in the SBA veteran Small Business Certification (VetCert) prior to contract award, during contract period of performance and must continue to remain registered through the final invoice payment. SDVOSBs are encouraged to respond to communicate interest in competing for this requirement to support requirement set-aside.
