Description
This Notice is Posted in accordance with (IAW) Federal Acquisition Regulation (FAR) subpart 5.2. This is a Sources Sought notice for any entity that wishes to challenge this requirement that the Government views strongly is a noncompetitive sole source action in accordance with (IAW) FAR 13.106-1(b) Soliciting from a single source. The services/products sought are from only one contractor, a large business, Eaton Corporation (Eaton). The contract is expected to be awarded as firm-fixed price and under the authority of a Sole Source Justification for Other Than Full and Open Competition. This is NOT a solicitation for proposals, proposal abstracts, or quotations. The purpose of this notice is to obtain information regarding: (1) the availability and capability of qualified small business sources i.e. HUBZone small businesses; service-disabled, veteran-owned small businesses; 8(a) small businesses; veteran-owned small businesses; woman-owned small businesses; or small disadvantaged businesses; (2) their size classification relative to the North American Industry Classification System(NAICS) code for this proposed acquisition; and (3) availability of domestic sources manufactured in the United States in sufficient and reasonably available commercial quantities and of a satisfactory quality. For this service requirement, small business responses must include: Breakdown of work between primary contract holder and subcontractors (if any) to ensure compliance with the limitations of subcontracting rule Size status of any subcontractor under the applicable NAICS code. All responses from responsible sources will be fully considered. Any prospective contractor must be registered in the System for Award Management (SAM) to be eligible for award. Your responses to the information requested will assist the Government in determining the appropriate acquisition method, including whether a set-aside is possible. It is not to be construed as a commitment by the Government to issue a solicitation or ultimately award a contract. Responses will not be considered as proposals or quotes. No award will be made because of this notice. The Government will NOT be responsible for any costs incurred by the respondents to this notice. This notice is strictly for research and information purposes only. The anticipated award date is no later than 12/15/2023. Background: VA s Tennessee Valley Healthcare System (TVHS), located at 1310 24th Avenue South, Nashville, TN 37212, procured two (2) Eaton brand Powerware uninterruptible power supply (UPS) model 9390-100-120 sometime in 2008 or 2009. The batteries in those units are nearing their end of life and require replacement. VA TVHS currently has a UPS service maintenance contract [36C24923P0364] with Eaton Corporation from 3/11/2023 through 3/10/2027, which does not appear to cover replacement of the UPS batteries rather it covers sealed battery preventive maintenance. Market research confirmed that these two Eaton Powerware 9390 UPS units use proprietary Eaton software for battery and power management and monitoring. These UPS units have been continuously maintained and serviced by Eaton-trained and -authorized personnel from initial installation to the present, resulting in continued extension of warranty coverage. Eaton s warranty does not cover the following: (d) repair or alteration not authorized in writing by Eaton personnel or performed by an authorized Eaton Customer Service Engineer or Agent; or (e) improper testing, operation, maintenance, adjustment, or any modification of any kind not authorized in writing by Eaton personnel or performed by an authorized Eaton Customer Service Engineer or Agent. Supply & Services Required: Acquisition of 80 new valve regulated lead acid (VRLA) batteries for the two Eaton Powerware 9390 UPS units. New batteries may be delivered direct to TVHS Nashville campus warehouse before other services are coordinated and completed. Replacement of all VRLA batteries in both Eaton Powerware 9390 UPS units. Note: Battery quantity per UPS unit is 40. Two UPS units brings a total of 80 VRLA batteries to replace. Disposal offsite of 80 VRLA Batteries and any related trash/waste. Troubleshooting, testing, calibrating of both UPS units in accordance with (IAW) Eaton Corporation standards Written Report(s) after replacement and testing showing UPS units with new VRLA batteries are fully-operational in all modes of function, IAW agency UPS standards and Eaton Corporation standards. Period of Performance: Overall, from award date to final acceptance date, the period of performance must take no longer than 60 calendar days. Installation, final testing, cleanup, and disposal is expected to take no more than one (1) normal, regular business day. The estimated cost of this service is less than $50,000.00 NAICS code: 811310, Electrical generating and transmission equipment repair and maintenance services (SBA Small Business Size Standard:$12.5 million) PSC: J061, Maintenance, Repair, and Rebuilding of Equipment Electric Wire and Power Distribution Equipment Capability statement /information sought. Companies that believe they possess the capabilities to provide the required products/services should submit documentation of their ability to meet each of the project requirements to the Contracting Officer. The capability statement must specifically address each of the project requirements separately. Additionally, the capability statement should include: 1) Company Name 2) SAM.gov Unique Entity ID, 3) Physical Address 4) the total number of employees, 5) the professional qualifications of personnel as it relates to the requirements outlined, 6) any contractor GSA Schedule contracts and/or other government-wide acquisition contracts (GWACs) by which all of the requirements may be met, if applicable, and 7) any other information considered relevant to this program. 8) Point of Contact Information having authority and knowledge to discuss responses with Government representatives. Include names, titles, addresses, telephone and fax numbers, and e-mail addresses. Interested parties must furnish information by email only with RESPONSE TO SOURCES SOUGHT NOTICE 36C24924Q0048 in the subject line. All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy this requirement to the POC in the cover sheet of this notice NO LATER THAN the given closing date and time on this notice. Confidentiality: No proprietary, classified, confidential, or sensitive information should be included in your response. The Government reserves the right to use any non-proprietary technical information in any resultant solicitation(s).
