5 SCOPE OF WORK 5.1 GENERAL This firm fixed price requirement is for the construction of a new Gas room to include the installation of gas manifolds to support the Microbiology lab (room 234-E) and Blood Bank (room 218-E-2) located at the Buffalo VA Medical Center 3495 Bailey Avenue Buffalo NY 14215 under VA project # 528-22-125. The creation of the new Gas room shall involve the dividing of IT room (223-E-1) into two smaller rooms (IT room 223-E-1 and Gas room 223-E-2), installation of gas lines and medical gas outlets to both the Microbiology lab (room 234E) and Blood Bank (room 218E-2), and the demolition of the current Gas room supporting both locations (room 236-E). The result of this project shall be a Gas room that can provide continuous and uninterrupted gas flow to the facility in accordance with NFPA 55 Guidelines for Gas Room. The Contractor shall provide personnel, material, services, supervision and facilities to perform, accomplish, and deliver the required services detailed in this scope of work. All requirements stated in this scope of work shall be completed within 180 days of award. 5.1.1 APPLICABLE DOCUMENTS The following documents are applicable to this Scope of Work (SOW) to the extent specified herein. While every effort has been made to ensure the completeness of this list, document users are cautioned that they must meet all specified requirements of documents cited in sections B.1.1.4 of this SOW, whether or not they are listed here. 5.1.2 GOVERNMENT DOCUMENTS The following directives, guides, handbooks, and drawings form a part of this document to the extent specified herein. Unless otherwise specified, the latest revisions available shall be used. Copies of construction related Department of Veterans Affairs directives, guides, and handbooks are available from the Office of Construction and Facilities Management website: http://www.cfm.va.gov/til/index.asp DEPARTMENT OF VETERANS AFFAIRS DIRECTIVES 1078 PRIVACY OF PERSONS REGARDING PHOTOGRAPHS, DIGITAL IMAGES, AND VIDEO OR AUDIO RECORDINGS PROJECT SPECIFIC DRAWINGS 5.1.3 VETERANS HEALTH ADMINISTRATION WESTERN NEW YORK DOCUMENTS The following drawings and documents form a part of this document to the extent specified herein. Documents identified as AS MODIFIED FOR VA PROJECT 528-22-125 are base VA documents that have been tailored to the needs of this specific effort. While the base VA documents are available on the Office of Construction and Facilities Management website listed above, the Contractor shall use the modified version listed below, NOT the base document. Copies of these documents are available from the Contracting Officer (CO), COR, or Technical Point of Contact (POC). 5.1.4 NON-GOVERNMENT PUBLICATIONS All work shall be accomplished in strict accordance with the latest codes and standards. The Contractor shall follow any/all applicable standards and codes, including, but not limited to applicable NFPA standards, NEC, JCAHO, OSHA, ANSI, ASHRAE, and any other codes. 5.1.5 ORDER OF PRECEDENCE In the event of a conflict between the text of this document and the references cited herein, the text of this document takes precedence. Nothing in this document, however, supersedes applicable laws and regulations unless a specific exemption has been obtained. 5.2 SCOPE OF CONSTRUCTION All work performed in accordance with this contract shall conform to the procedures outlined in PG-18-1: MASTER CONSTRUCTION SPECIFICATIONS (528-22-125). The scope of construction work is fully described in the scope narrative below and attached drawings and specifications. Division of room 223-E and construction of new IT room (223-E-1) and Gas room (223-E-2) Built new gas room by divided the existing IT room (223-E) into two separate rooms (IT room 223-E-1) and Gas room (223-E-2). The total area of new Gas room (223-E-2) is approximately 40 square feet. The total area remaining for the IT room (223-E-1) is approximately 104 square feet. Install new acoustical ceiling grid and tiles in both subdivided rooms. Install new ceiling LED lights, diffusers and sprinkler heads in both subdivided rooms. Install Automatic Medical Gas Manifolds regulate and monitor gas cylinder pressure in the Gas room (223-E-2) to provide continuous and uninterrupted gas flow to the facility. All work on medical gas systems shall be performed by ASSE 6010 certified technicians and shall be inspected by a third-party ASSE 6020 certified inspector. The inspector shall be provided by the VA. Install new LCD medical gases alarm system in the new gas room. Install new RTU dedicated exhaust fan to provide continues negative pressure in the gas room. The entire gas room shall be under emergency power. Connect the Microbiology lab (room 234E) and Blood Bank (room 218E-2) to new Gas room (223-E-2) Install new medical gas pipelines and new medical gas outlets for the blood bank and the microbiology to provide gases for the existing equipment (Incubators). Install new LCD medical gases alarm system in the blood bank and microbiology. Protect the blood bank and the microbiology machines, shelves, and other equipment s during the construction. Maintain humidity, ventilation, and temperatures within the manufacturers during the construction. Coordinate with the VA engineering for any required shutdown or power outage to complete the final connection and testing the system. Coordinate with the VA engineering for the work hours during the construction to ensure that operations in the Blood bank and Microbiology lab are not impacted by construction activities. Demolish the existing gas room (gas control system and accessories) and all associated parts. 5.2.1 SITE CONDITIONS, AS-BUILTS AND RECORD DOCUMENTS Although the VA makes every effort to keep drawings current to existing conditions, changes and updates are sometimes not recorded. It is therefore the Contractor s responsibility to perform field investigation and verify of the accuracy of the drawings with the actual conditions. The contractor shall check existing conditions at the project site prior to bidding. The requirement for asbestos abatement is not anticipated in area where the construction shall take a place. 5.2.2 PHASING Although there is a formal phasing required for this project, work shall be focused on the same general portion of the building in order to minimize disruptions to the facility. The project drawings provide a recommended phasing plan to minimize the outage and keep the blood bank and microbiology operate during the construction; however, the contractor may submit their own phasing plan to the VA for review and approval. 5.2.3 ITEMIZED CONDITIONS Any wall or ceiling mounted signage, alarms, decoration, or other ancillary feature that require temporary removal or relocation to complete the renovations shall be the contractor s responsibility to remove and reinstall. If any signage, alarms, or other feature is damaged during construction, the contractor shall replace with an equivalent device as approved by the COR at no additional cost to the VA. The contractor shall be responsible for disposing of all demolished materials. A dumpster may be placed onsite; however, it cannot be placed in a manner that blocks or interrupts vehicle or pedestrian traffic. Dumpster location shall be coordinated with and approved by the Contracting Officer s Representative (COR). 5.2.4 UTILITY SHUTDOWN Although there is a formal utility shutdown required for this project, work shall be focused on the same general portion of the building in order to minimize disruptions to the facility. The project drawings provide a recommended utility shutdown plan to minimize the outage and keep the Microbiology and Blood Bank department operate during the construction; however, the contractor may submit their own phasing plan to the VA for review and approval. Any utility shutdown required to complete work shall be coordinated with VA engineer a minimum 30 days in advance of the shutdown and shall be performed outside of regular business hours. Regular business hours shall be defined as 7:00AM-5:00PM Monday through Friday. 5.3 SUBMITTALS The contractor shall provide submittals and shop drawings for review prior to starting work. All submittals shall be approved by the COR prior to starting work associated with the submittal. Each submittal shall contain: Project title Location Project number Date Subcontractor name if applicable Associated section of specification Product identification Revision number if submittal is not initially approved. The VA will return submittals to the contractor notated as Approved , Approved as Noted , Revise and Resubmit or Not Reviewed . A submittal log has been generated for this effort and represents a list of the minimum required submittals based upon the current construction documents. Although every attempt has been made to ensure that this list is complete, additional submittals not listed may be required. Measures may include use of plastic sheeting, keeping doors closed, taping door seams, and utilizing tools and equipment fitted with HEPA vacuums. Furthermore, Rooms under construction shall be maintained under negative air pressure. Carbon filters shall be placed on all exhaust air vents. Additional requirements may be needed to comply with the conditions of the permit. Detailed schedule that includes all initial preparations, administrative work and show associated predecessor and successor logic associated with all tasks performed under this contract. Structural report prepared, signed and stamped by a New York State licensed Professional Structural Engineer. The structural report shall include the following information at a minimum: The location of the proposed roof penetration to include the exact location of existing steel beams. The penetration shall not negatively impact the structural integrity of the existing roof. Provide supporting analysis and calculations verifying that the proposed RTU restraint system will adequately restrain the RTU against all loads, including wind, snow and live loads. Verify proposed rtu anchoring systems are proper for the application. If proposed anchoring systems are found to be inadequate, the structural engineer shall provide / design alternate anchoring systems and submit to the cor for review and approval prior to start the construction. The contractor and the structural engineer shall coordinate with the component manufacturer(s) as needed to accurately define the basis of calculations and analysis. If the report finds that the roof requires modifications, additional reinforcements, or an alternate location, the structural engineer shall design the appropriate modifications to existing and/or proposed structures for review and approval by the VA prior to start the construction. 5.3.1 AUTODESK BUILD CONSTRUCTION MANAGEMENT PLATFORM: The Contractor shall utilize VISN 2 Autodesk Build Construction management platform, also called Autodesk Construction Cloud (ACC). Access to the platform and training portal will be provided by VISN 2 through project Contracting Officer Representative (COR) at no cost for the duration of the project. Autodesk Build is the management and collaborative environment that VISN 2 uses for all its Non-Recurring Maintenance (NRM), Minor Program projects, Feasibility Studies, Commissioning and Retro-Commissioning contracts.  There is no user, license, or subscription fee to the contractor for using this cloud-based platform. The Contractor shall accomplish and complete the following tasks upon award of contract: Request access to ACC platform and ProductivityNOW eLearning Site to project VA COR within 14 days of contract award. Only staff that shall utilize the platform to be granted access. Examples: Project manager, sub-contractors POC, Site manager, Safety officer, etc. The access request shall be in writing and include a list of staff. The list shall include the following information: Full Name Company Name Email Address Role/Position on the project (i.e., Project manager, site super) Contractor staff granted access to the ACC platform shall complete ACC training through ProductivityNOW eLearning platform and provide certificates of completion to COR within 12 Calendar days of access being granted. Initial access to ProductivityNOW eLearning platform shall expire after 12 Calendar days after online access is granted. Additional Staff and Subcontractors can be added at any time with a request submission to the project COR as described in section B.1.3.1. C.. The contractor shall only use the ACC platform for contract required submissions, official project correspondence to be acknowledged, reviewed, and actioned by the responsible party. No additional time shall be added to the contract, nor an increase in contract amount be provided for the contractor s failure to utilize the ACC platform as the project s official communication and collaboration system. Any correspondence out of platform shall not be the governing authority contradicting direction and will be at the contractor s expense. Official project correspondence and collaboration includes but not limited to: RFIs, submittals, schedules, shutdown requests, actionable tasks, reports, testing, safety inspections, photos, and site surveys. Contractor shall inform the COR of any staff changes within 2 business days from the change. Staff changes pertains to staff granted access to the ACC platform. Contractor shall request termination of access, replacement of personnel and/or any other action that might impact the contractor ability to maintain required utilization of the platform. Contractor submission requirements cannot be accepted for work to begin without meeting all ACC Platform requirements outlined herein, including completing required ACC platform training. 5.4 SITE INFORMATION 5.4.1 SAFETY All Contractor personnel working onsite at the Medical Center shall be required to attend a Buffalo VAMC site specific safety training class. This class shall be held on site and will be taught by a member of the Buffalo VAMC Safety Office. Attendance to this class and proof of the 10-hour OSHA requirement shall allow Contractor personnel to obtain a photo ID badge from the Buffalo VAMC Police. All Contractor personnel shall always wear this badge above the waist while on the Buffalo VAMC campus. Participation in this class is mandatory and shall be completed prior to the commencement of work on-site. If this training has been completed previously (as evidenced by a valid Buffalo VAMC Contractor Photo ID) within the last three years, then no repeat training shall be required until the printed expiration date. Personnel shall attend the safety training class to renew an existing badge. The Contractor shall responsible for obtaining / providing, inspecting, and maintaining any required Personal Protective Equipment (PPE) and access equipment (lifts, scaffolding, etc...) necessary to perform services identified in this SOW and associated project documents. The VA does not anticipate any Hazardous Material Removal for this project. If suspect material is identified by the Contractor, the Contractor should stop work and notify the VA COR immediately. 5.4.2 ACCESS Although the VA Western New York Health System campuses are public facilities, access to facility maintenance areas, electrical areas, mechanical areas, roof access, and certain other portions of the medical facility are restricted from the general public. Accessing these areas may require advance notice, pre-approval, and scheduling to gain entry. All visits and access requests to the VAWNYHS under this scope of work shall be coordinated through the COR. 5.4.3 SECURITY The construction site shall at all times be secured by a VA approved lock. Keys to the lock shall be issued to the following individuals: Contractor s site supervisor, VA COR, VA Police Force, and VA Key Control Supervisor. No individual shall be provided access to the construction site without approval from the VA. Subcontractors shall be provided access to the site by the Contractor s site supervisor, who shall remain onsite for the entirety of the subcontractor s work, and following the work shall secure the site, after a complete site inspection. 5.4.4 PHOTOGRAPHY It is VHA policy to respect the privacy of all persons (e.g., Veterans, patients, residents, members of the VHA workforce, and visitors) consistent with the needs of operating a national health care system. Privacy protections on VHA premises vary according to the needs and purposes of different types of areas, the persons included, and the purpose of the production and use of photographs, digital images, and video or audio recordings (excerpt from VHA Directive 1078). Photography of as built and site conditions are permissible actions under this SOW when photography activities are coordinated with the COR. The Contractor shall ensure that any photographs taken do NOT include any VHA patients, members of the VHA workforce, or visitors to the VAMC facility. 5.4.6 VHA SUPPLEMENTAL CONTRACT REQUIREMENTS FOR ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS Contractor employees who work in or travel to VHA locations must comply with the following: Documentation requirements: If fully vaccinated, shall show proof of vaccination. NOTE: Acceptable proof of vaccination includes a signed record of immunization from a health care provider or pharmacy, a copy of the COVID-19 Vaccination Record Card (CDC Form MLS-319813_r, published on September 3, 2020), or a copy of medical records documenting the vaccination. If unvaccinated and granted a medical or religious exception, shall show negative COVID-19 test results dated within three calendar days prior to desired entry date. Test must be approved by the Food and Drug Administration (FDA) for emergency use or full approval. This includes tests available by a doctor s order or an FDA approved over-the-counter test. Documentation cited in this section shall be digitally or physically maintained on each contractor employee while in a VA facility and is subject to inspection prior to entry to VA facilities and after entry for spot inspections by Contracting Officer Representatives (CORs) or other hospital personnel. Documentation will not be collected by the VA; contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.  Contractor employees are subject to daily screening for COVID-19 and may be denied entry to VA facilities if they fail to pass screening protocols. As part of the screening process contractors may be asked screening questions found on the COVID-19 Screening Tool. Check regularly for updates. Contractor employees who work away from VA locations, but who will have direct contact with VA patients shall self-screen utilizing the COVID-19 Screening Tool, in advance, each day that they will have direct patient contact and in accordance with their person or persons who coordinate COVID-19 workplace safety efforts at covered contractor workplaces. Contractors shall, at all times, adhere to and ensure compliance with federal laws designed to protect contractor employee health information and personally identifiable information.  Contractor must immediately notify their COR or Contracting Officer if contract performance is jeopardized due to contractor employees being denied entry into VA Facilities. Masking and Physical Distancing While in Covered Contractor Workplaces Covered contractors must ensure that all individuals, including covered contractor employees and visitors, comply with published CDC guidance for masking and physical distancing at a covered contractor workplace. COVID-19 Coordinator Designation Covered contractors must designate a person or persons to coordinate implementation of and compliance with these workplace safety protocols at covered contractor workplaces. Please take the time to visit the Safer Federal Workforce Task Force website at https:/www.saferfederalworkforce.gov/contractors/ for more information and guidance. 5.5 COMMUNICATIONS 5.5.1 STATUS UPDATES The Contractor shall provide monthly status reports throughout the duration of the contract. The reports shall include at a minimum the information listed below. The status report will be supplied as a digital product to the Government in a Microsoft Word compatible format (*.DOC) or Portable Document Format (*.PDF) that can be emailed to COR, however, note that the VA email cannot accept file sizes larger than 5mb. Files over that size may be provided through an internet-based file sharing software such as SharePoint. The reporting period shall begin once the Notice to Proceed has been issued to the contractor. Information required in monthly status reports: Progress Report Update Itemized list of progress completed during the reporting period Itemized list of tasks behind schedule Updated project schedule Any Requests for future work, i.e. access, Shutdowns, Utility coordination, VA Engineering team assistance, etc. Project and safety issues, or other concerns Negative air pressure monitoring Log Readings shall be taken manually every hour, 24hrs a day/ 7 days a week once construction has begun. Photographs of work taken during the reporting period, specifically the following iterations: As built (pre-demo) images of any exposed electric., gaselines or other utility system Completed demolition, showing base conditions Progress photos Photos of any area of concern 5.5.2 MEETINGS 5.5.2.1 KICK-OFF MEETING AND SITE SURVEY The Contractor shall conduct a kick-off meeting at the VAMC. During the kick-off meeting the Contractor shall address their plan to meet the design intent, review the schedule, and review their plan to address any risks associated with the effort. In preparation for this meeting Contractor shall submit: An updated work plan that adds additional details based upon approved submittal information. Revised or new Activity Hazard Analysis (AHA) based on approved submittals. Any additional clarifying details about the work to be performed that have been updated bases upon the approved submittals. Any action items resulting from this meeting shall be addressed prior to ordering any materials or beginning the actual construction work. In conjunction with the Kick-off Meeting, the Contractor shall survey the existing area to assess current site conditions and gather information necessary to carry out required tasks. 5.5.2.2 PRECONSTRUCTION CONFERENCE Submittals 1-9 as listed above shall be submitted and approved prior to the start of work on site. At such time the Contractor shall attend a Preconstruction Conference. Topics to be covered at this meeting shall include: Introductions Names of representatives attending [list the names of all participants along with the departments they are leading]. Discussion of the construction contract. Schedule for the completion of the contract. Review of the construction plans. Working area limits. Storage and staging areas. Construction safety and ICRA. Final comments and notes. 5.5.2.3 MONTHLY PROGRESS MEETINGS Progress meetings shall be held once each month beginning after the initial kickoff meeting. Meeting location and exact schedule shall be addressed during the kickoff meeting. The intent of the meetings is to discuss the project schedule, status of submittals and RFIs, construction progress, cause of delays, issues / concerns and safety and review the status report. Meeting Minutes The Contractor shall provide meeting minutes to document discussions had during the meeting. Meeting minutes may be organized in Contractor specified format. Meeting minutes shall be supplied as a digital product to the Government in a Microsoft Word compatible format (*.DOC) or Portable Document Format (*.PDF). The contents of meeting minutes shall include at a minimum the following information/topics: Meeting attendees Narrative to describe contents of meeting (will likely mirror the meeting agenda) List of action items (for both the Government and the Contractor) The Contractor shall provide draft meeting minutes within 5 business days of the meeting. The VA shall review and provide comments back to the Contractor. The Contractor shall finalize the meeting minutes and submit the final meeting minutes to the Government within 3 business days of receipt of Government comments. 5.6 QUALITY ASSURANCE/QUALITY CONTROL PLAN The Contractor shall be responsible for reviewing works they complete as well as work done by any subcontractors that the Contractor has hired to assist with the completion of this SOW. The Contractor shall provide the Government with a Quality Assurance/Quality Control (QA/QC) Plan that documents the methods, processes, procedures that are going to be implemented by the Contractor to validate the work that they and their subcontractors perform. 5.7 CONSTRUCTION INSPECTION Periodic formal and informal construction inspections shall be performed by VA staff throughout the construction process to assess the quality and compliance of the project in comparison to the Contract Documents. Typical inspection examples include review of safety, dust and infection control systems and configurations, review of floor preparation and moisture testing results, checking of coverings and protection devices / materials, observation of application of the ventilation system, protection during cure and final inspection of the finished product. Timing of inspection points shall be discussed with the VA COR during the development of project construction schedule submittal (Section B.1.3 E. 9)). Any findings identified during an inspection shall be photographed, documented in writing, and delivered to the contractor. The Contractor shall respond in writing and provide evidential proof of compliance/rectification/resolution to each finding identified. Some findings may require resolution prior to moving to the next construction process. 5.8 VERIFICATION Final inspection of the installed floor shall be conducted jointly before final acceptance of the constructed product. The groups that shall participate in the verification process include: Prime Contractor Subcontractor (as applicable) VA Engineering These inspections will be based upon manufacturer data and will be checked against VA regulatory requirements as applicable. Any work that does not pass inspection, the Contractor shall troubleshoot the issue and determine if the FboNotice cause of the problem. If the FboNotice cause is the result of the construction work, the Contractor shall repair and/or replace the faulty construction work and any subsequent damage at no additional cost to the Government. If the FboNotice cause is the result of faulty equipment or materials (manufacturer defect), the Contractor shall coordinate with the manufacturer / supplier to repair and / or replace the faulty equipment or materials and any subsequent damage at no additional cost to the Government.
