NOTICE OF INTENT to Sole Source SOLICITATION NUMBER: 75N95024Q00042 TITLE: �Maintenance Support Services for Leica Stellaris 8 Confocal Microscope CLASSIFICATION CODE: J066 � Maintenance, Repair, and Rebuilding of Equipment � Instruments and Laboratory Equipment NAICS CODE: 811210 � Electronic and Precision Equipment Repair and Maintenance � RESPONSE DATE: December 8, 2023, 4:00 pm EST PRIMARY POINT OF CONTACT: Claudia Ventola��������� Claudia.ventola@nih.gov Phone: 301.496.0870 DESCRIPTION: INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA), on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a purchase order for a Maintenance Support Services for Leica Stellaris 8 Confocal Microscope and all its associated system parts and software used by its researchers and scientists in NINDS. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811210 � Electronic and Precision Equipment Repair and Maintenance with a Size Standard of $34 Million. � REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2023-04 dated June 02, 2023 DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: Maintenance Support Services for Leica Stellaris 8 Confocal Microscope from Leica Microsystems. PERIOD OF PERFORMANCE: The anticipated period of performance shall include one 12-month base period and two additional options: 12/15/2023 � 12/14/2024 (Base) 12/15/2024 � 12/14/2025 (Option 1) 12/15/2025 � 12/14/2026 (Option 2) CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The National Institutes of Health (NIH) is the nation�s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people�s health and save lives. The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), which mission it is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease for all people. The Leica confocal microscope stellaris 8 is a highly used shared research equipment for multiple NINDS research groups, the proper maintain and timely and efficient service is critical for the research projects conducted at NINDS. The Leica confocal microscope stellaris 8 purchased, is an advanced research equipment shared by multiple research groups in NINDS. The proper maintenance and timely and efficient service is critical for the research projects conducted at NINDS. A follow-on service and maintenance agreement is sought to ensure the highest quality up-keep of this equipment. Leica Microsystems, Inc. is the only contractor who has manufacturer-trained and certified technicians to maintain and upgrade their patented and proprietary software and hardware.� They are the only firm who can provide updates to their scientific equipment and software.� They are the only firm who manufactures and certifies replacement parts for this equipment.�� All required parts and supplies for the Leica Stellaris 8 Confocal Microscope, must be purchased from Leica Microsystems, Inc.� Replacement parts or accessories must be compatible with the existing Leica Microsystems, Inc., Stellaris 8 Confocal Microscope. Compatibility with this equipment is required to maintain the validity of the warranty agreement and Leica Microsystems, Inc. is the only source.� All manufacturer training is provided for Leica Microsystems, Inc. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B.
