- 52.232-18 Availability of Funds. Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. The 122nd Fighter Wing seeks a small business contractor to supply two (2) UTVs with cab enclosures, door accessories, and defrost w/heat & ventilation capability. The attached ""Combo"" document includes an extended description of the requirement with a suggested make/model (Can-Am Defender Max HD7) and manufacturer's part #s. This is being solicited as BRAND NAME OR EQUAL. Other special considerations may also be found in the attached document. When submitting a quote for this requirement, contractors are encouraged to provide as much information as possible about any alternative make/model so that a comparative analysis of quotes may be made. Other manufacturers, older model years, and used/reconditioned/remanufactured models will be considered - as noted on the attached document - but adequate information about alternative products (e.g., mileage, condition, warranty, tire tread, etc.) must be provided in order to make an informed decision on best value for the Government. In accordance with FAR 13.106-2 -- Evaluation of Quotations or Offers, quotes will undergo a comparative evaluation to determine which quote presents the best overall value to the Government in terms of price and product function, performance, quality, reliability, maintainability, capability, condition, etc. as determined by readily available commercial consumer feedback and any supplemental information submitted with quotes. Quotes will be evaluated by performing a direct comparison of one quote with another in a uniform manner to determine which quote satisfies the Government's need at the best value. The Government reserves the right to consider a quote that provides more than the stated minimum and award a contract to that quoter if it provides additional benefit to the Government. The Government has the discretion to accept other than the lowest priced quote which provides additional benefits, and the Government reserves the right to select a response that provides benefit to the Government which exceeds the stated minimum requirement, but is not required to do so.
