- Description
- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 as supplemented with additional information included in this notice.� This announcement constitutes the only solicitation and a separate written solicitation will not be issued.� This solicitation number 75N94024Q00130�and is issued as a Request for Quotation (RFQ).� The solicitation/contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2024-05.� The North American Industry Classification (NAICS) Code is 332999 and the business size standard is 750e.� However, this solicitation is not set aside for small business.� This acquisition is being conducted using Simplified Acquisition Procedures in accordance with FAR Part 13.� Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD) intends to contract on a sole source basis with Lab Products, LLC of Aberdeen, MD, to procure the following item: ITEM# 76015E �-� Enviro-Gard III� HEPA filtered air exhaust unit w/controller � Qty (8) EA Lab Products is the only vendor currently making these Enviro Guard Ill air supply units with controllers, as they are custom designed to work specifically with the existing Lab Products animal housing racks the facility already has in use. The specification and R&D work have already been completed and the company is able to move into production. �No other vendor can do this without the facility providing a sample of each caging equipment along with specifications and dimensions of the animal housing racks in use for the alternative vendor to determine if they are able to produce the equipment needed. This will result in more down time for the facility and ultimately an inability for the facility to keep up with cage changing schedules and the demand for clean water for all the research animals housed in the facility.� An alternate vendor would have to acquire the Lab Product�s proprietary specification for the air supply unit and controller used throughout the building animal facility to be able to construct a sample that would then need to be tested to ensure it is compatible with the Lab Products animal racks, which again would result in more down time, etc. The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under authority of the 41 U.S.C. 253(c) (1), FAR 6.302.� This synopsis is not a request for competitive proposals. The offeror must include a completed copy of the provision of FAR Clause 52.212-3, Offeror Representations and Certifications � Commercial Items with its offer.� The provisions of FAR Clause 52.212-1 Instructions to Offerors � Commercial Items; FAR Clause 52.212-2, Evaluation � Commercial; FAR Clause 52.212-4, Contract Terms and Conditions � Commercial Items; and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders � Commercial Items � Deviation for Simplified Acquisitions applies to this acquisition.� The offeror must include their Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size.� The clauses are available in full text at http://www.acquisition.gov/far/.
