NOTICE OF THE INTENT TO SOLE SOURCE TO OEM LB Bard Peripheral Vascular, Inc. (Bard), UEI: FKCCNJXL9TM7, a wholly owned subsidiary of Becton, Dickinson, and Company ( BD ) 850 W Rio Salado Parkway Tempe, AZ 85281, UNITED STATES. Response Due Date: June 20, 2024, by 10:00AM (EST) NOTICE OF THE INTENT TO SOLE SOURCE SYNOPSIS Network Contract Office 1, Procurement Office East on behalf of The Department of Veterans Affairs, Providence VA Medical Center, 830 Chalkstone Avenue, Providence RI 02908-4734 intends to award a firm-fixed contract for delivery of (10) Fluency Plus Endovascular Stent Grafts for Providence VA Medical Center s Interventional Radiology Service. The proposed procurement is for services for which the Government intends to solicit and negotiate with only one source in accordance with FAR13.106-1(b). The North American Industry Classification System code (NAICS) for this requirement is 339113. All responsible sources that feel they should be considered qualified to provide the above-mentioned products may submit a response to this notice (by the response due date shown above) to Divianna.Mathurin@va.gov. The information provided shall include detailed (and relevant) documentation to allow the government to perform adequate market research and make a proper determination. A determination by the government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. THERE IS NO SOLICITATION AVAILABLE AT THIS TIME. REQUESTS FOR A SOLICITATION WILL NOT RECEIVE A RESPONSE. Statement of Work Bard Fluency Plus Providence VA Medical Center SCOPE OF WORK: The Contractor shall provide endovascular stents. EQUIPMENT The following stents are to be supplied by Bard Medical corporation. These specific stents are required by the radiologist to provide the highest level of patient care and safety. No other stents will be technically acceptable. Radiology is expanding it Interventional Radiology Service and will provide A-V Fistula maintenance and repairs requiring the use of these stents. SALIENT CHARACTERISTICS Fluency stents have been shown to be superior to bare metal stents (longer primary and secondary patency rates) for the treatment of stenosis in dialysis fistulas and grafts in randomized controlled, trials. Fluency stents are specifically FDA approved for the treatment of dialysis fistulas and grafts. The Vendor shall provide the following stents, (qty 2 ea.): Fluency STENT FOR AV WORK BD 8fr FEM07040 Fluency STENT FOR AV WORK BD 9fr FEM08040 Fluency STENT FOR AV WORK BD 9fr FEM09040 Fluency STENT FOR AV WORK BD 9fr FEM10040 Fluency STENT FOR AV WORK BD 10fr FEM12040 AREAS TO BE SERVICED Department of Veterans Affairs Providence VA Medical Center Interventional Radiology 830 Chalkstone Ave Providence, RI 02908 INSPECTION AND ACCEPTANCE a) The Contractor shall conduct a joint inspection with the COR upon delivery of equipment. b) Contractor shall provide dates of completion of punch list items and replacement parts and/or short ship items from the manufacturer(s). c) The COR shall ensure all work is completed satisfactorily prior to acceptance. Disputes shall be resolved by the Contracting Officer. TASK FREQUENCY AND INSTRUCTIONS This is a one-time purchase of these product on this contract SPECIAL WORK REQUIREMENTS The Contractor shall comply with all Infection Control Risk Assessment requirements deemed appropriate by the Providence VA Medical Center for the stated products Records Management Language for Statement of Work (SOW): The following standard items relate to records generated in executing the contract and should be included in a typical procurement contract: Citations to pertinent laws, codes, and regulations such as 44 U.S.C chapters 21, 29, 31 and 33; Freedom of Information Act (5 U.S.C. 552); Privacy Act (5 U.S.C. 552a); 36 CFR Part 1222 and Part 1228. Contractor shall treat all deliverables under the contract as the property of the U.S. Government for which the Government Agency shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest. Contractor shall not create or maintain any records that are not specifically tied to or authorized by the contract using Government IT equipment and/or Government records. Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected by the Freedom of Information Act. Contractor shall not create or maintain any records containing any Government Agency records that are not specifically tied to or authorized by the contract. The Government Agency owns the rights to all data/records produced as part of this contract. The Government Agency owns the rights to all electronic information (electronic data, electronic information systems, electronic databases, etc.) and all supporting documentation created as part of this contract. Contractor must deliver sufficient technical documentation with all data deliverables to permit the agency to use the data. Contractor agrees to comply with Federal and Agency records management policies, including those policies associated with the safeguarding of records covered by the Privacy Act of 1974. These policies include the preservation of all records created or received regardless of format [paper, electronic, etc.] or mode of transmission [e-mail, fax, etc.] or state of completion [draft, final, etc.]. No disposition of documents will be allowed without the prior written consent of the Contracting Officer. The Agency and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701. Records may not be removed from the legal custody of the Agency or destroyed without regard to the provisions of the agency records schedules. Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, this contract. The Contractor (and any sub-contractor) is required to abide by Government and Agency guidance for protecting sensitive and proprietary information.
