Special Notice Special Notice Page 5 of 5 Special Notice *= Required Field Special Notice Page 1 of 5 The Department of Veterans Affairs, Network Contracting Office 12, hereby provides notice of its Intent to award a Sole Source, Firm Fixed Price contract to Ossur Americas, Inc., a large business, located at 200 Spectrum Center Drive Suite 700, Irvine, CA 92618. The contract is expected to be awarded under the authority of 41 U.S.C. 3304(a)(1), as implemented by FAR 13.106-1(b) Soliciting from a Single Source. A Justification & Approval (J&A) for Single Source Awards for Other Than Full and Open Competition, (OTFOC) has been prepared as there is only one identified responsible source, and no other supplies will satisfy agency requirements. The total value of the award is $106,510.80 determined to be fair and reasonable by the Contracting Officer based on the current commercial price list available to the public. The anticipated award date is July 05, 2024, close of business. The Contractor will provide Power Knee - Prosthetic used in conjunction with other pertinent items, Ossur Americas, Inc., is essential to continue the Research & Development (R&D), of utilizing a powerful motor that will fill the absence of muscle power. Along with the RHEO Knee XC shall provide the additional needed items to support the research study. The following items will be procured: Line Number Item Description 001/PKA10003 Power Knee to include (3) year warranty 002/RKNXC0003 RHEO Knee XC to include (3) year warranty 003/Shipping FOB - Destination Period of Performance: Upon Delivery (0 Option Years) Delivery: FOB - Destination only NAICS code: 339113 Surgical Appliance and Supplies Manufacturing (SBA Size Standard 1,000 employees) PSC: 6515 Medical & Surgical Instruments THIS NOTICE OF INTENT IS NOT A SOLICITATION OR REQUEST FOR COMPETITIVE QUOTES. However, interested parties may identify their interest and capability to respond to this requirement within the deadline of this notice. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement. The Department of Veterans Affairs will NOT be responsible for any costs incurred by interested parties in responding to this Notice of Intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this Notice of Intent, the Government shall determine if a solicitation will be issued. Any prospective Contractor must be registered in the System for Award Management (SAM) to be eligible for award and must submit a current Authorized Distributor letter from the manufacturer (If applicable). All Service-Disabled Veteran Owned and Veteran Owned Small Businesses must submit a self-certifying statement that their company meets all criteria established IAW 13 CFR 121.406(b)(1)(i) through (b)(1)(iii) thus demonstrating compliance with the Non-Manufacturer Rule. The capability documentation should include general information and technical background describing in detail the prospective contractor's capabilities and experience that will demonstrate the ability to support these requirements. ~END~
