- NOTICE OF INTENT TO SOLE SOURCE The U.S. Army Corps of Engineers (USACE), Jacksonville District intends to solicit and contract with Geomar Environmental Consultants Inc. (CAGE 73BL2), of Cocoa, FL, on a sole-source basis to conduct environmental services for Threatened and Endangered (T&E) sea turtle species and nesting shorebirds within the project footprint of the Canaveral Sand Bypass VI (CSBP VI) beach Fill Area located in Brevard County, Florida, between approximately R-01 and R-54.5. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541620, Environmental Consulting Services. A sea turtle monitor is required for this effort and must be permitted by the state.� Under Florida Statute 379.2431 (1) and Florida Administrative Code Rule 68E-1, the Florida Fish and Wildlife Conservation Commission (FWC) can only issue a permit for sea turtle conservation work if there is a need for that activity.� On beaches where FWC has already issued a permit to an individual, organization, or firm to conduct nesting surveys, the FWC does not issue a second permit unless additional activities not being conducted by the existing permit exist. Geomar Environmental Consultants Inc. is the only Marine Turtle Permit Holder for the Brevard County locations identified in the Performance Work Statement (PWS). Additionally, within Florida Administrative Code Rule 68E-1, the FWC lists a timeframe of 90 days for approval or denial of permit requests.� As the services are required to begin during the month of July 2024, and as no other entities have requested and/or been granted such a permit, the Contracting Officer has determined that competing this requirement is not advantageous to the Government.� In support of the FWC goals to mitigate impacts on turtle habitats, Geomar Environmental Consultants Inc. will be the only contractor solicited to perform monitoring efforts for both the sea turtles and the nesting shorebirds. To onboard another contractor to perform shorebird monitoring efforts would increase the risk of turtle habitat disturbances. Therefore, this requirement will be solicited using other than full and open competition in accordance with FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
