Description
The Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division� (AMD) of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis with Bruker Biospin Corporation of Billerica, MA, for an upgrade to a NIST-owned Bruker 700 MHz console and cryoprobe upgrade, including delivery, installation, training, warranty, and maintenance. The Material Measurement Laboratory, Chemical Science Division (CSD), operates, maintains, and manages two high field Bruker Avance II magnets (800 and 700 MHz) at the Nuclear Magnetic Resonance (NMR) Facility at the Hollings Marine Laboratory in Charleston, SC. CSD�s existing NMR systems have reached end of service, meaning the manufacturer no longer supports these instruments. System upgrades are required to maintain mission critical activities such as the productive and successful NMR-based metabolomics program which relies on the Bruker Avance II 700 MHz� equipped with a cryogenic triple resonance probe and a refrigerated sample automation system. The Avance (AV) II spectrometer series is no longer available for service contract coverage; and is four (4) generations behind modern spectrometers. The AVII was replaced with AVIII in 2007, then AVHD in 2013, and as of 2017 the present NEO series. Parts are no longer available for preventive maintenance and repairs. With respect to the probe system, the cryoplatform and cryoprobe are no longer serviced by the manufacturer, nor are parts available. The upgrade, to the NMR console and 5 mm triple resonance cryogenically cooled probe for the 700 NMR system will allow sensitive, precise and accurate measurements of biological and organic molecules, heterogeneous mixtures of these molecules and complexes formed by these molecules in solution or solid state. Furthermore, technological developments incorporated in newer instruments will expand NIST�s capabilities in NMR measurements necessary to maintain� NIST�s competitive and leading-edge research programs and grow �capabilities in 19F measurements where fluorine NMR provides an unbiased and SI-traceable alternative to current spectroscopic techniques. The system upgrade must include all of the following: -Replace the existing 700 MHz NMR with a new generation NMR console and 5 mm triple resonance cryogenically cooled probe; -Replace the existing Avance II console and probe including all equipment, the cryoplatform and helium compressor, autosampler parts, a windows workstation and software; -Integrate all upgraded equipment, as a unit, with the existing system; -Maintain capabilities of current accessories including a room temperature triple resonance probe, a high-resolution magic angle (HRMAS) spinning probe, a 1 mm microprobe, and a SampleJet autosampler; -Installation; -Training; and -Extended warranty. � Sole source determination is based upon the following: NIST-owned equipment are commercial items that were manufactured by Bruker Biospin Corporation. Bruker has proprietary rights to the existing equipment and is the sole manufacturer and distributor of the equipment. Bruker has no authorized resellers or service providers, therefore, only they can supply the required hardware, software and service and guarantee that the maintenance and parts will be fully compatible with, meet the performance specifications for the equipment, and fully integrate with the existing system. � Only Bruker has access to performance verified component parts, spare parts, software, technical support, and the latest firmware and software updates available for the system. Bruker manages a staff of trained, certified field technicians/engineers. Bruker does not train and certify technicians outside of their own company. The North American Industry Classification System (NAICS) code for this acquisition is 334516 and the small business size standard is 1,000 employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by July 18, 2024, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses must, at a minimum, clearly explain how the Contractor maintains the required expertise, technology, equipment, parts, business relationships and resources necessary to successfully complete all required work.
