Page 1 | 1 NOTICE OF INTENT TO SOLE SOURCE The Department of Veterans Affairs, Network Contracting Office (NCO) 22, located at 4811 Airport Plaza Drive, Long Beach, CA 90815 is issuing this Notice of Intent (NOI) to inform industry contractors of the Government s intent to execute a Sole Source Award under FAR Part 13 Simplified Acquisition Procedures (SAP) for a one (1) year, firm-fixed-price contract to Fisher Scientific Company, LLC. (Fisher) located at 11450 Compaq Center West DR STE 570, Houston, Texas 77070. The VA Greater Los Angeles Healthcare System (VAGLAHS) requires ANA testing reagents, supplies, and consumables and service maintenance plan on the existing Helios system for a period of one year. The Contractor shall provide Helios Gold preventive maintenance and service plan on the Helios system to include a 98% uptime guarantee, on-site/priority response time of between 24 and 36 business hours excluding weekends and holidays, unlimited on-site service visits per year with labor and travel included and parts and consumables included unless an Excluded Item, telephone support, one free operator training slot and two (2) preventive maintenance visits per year, each with a preventive maintenance kit. The Contractor shall provide on-site preventive maintenance and system inspections as necessary to maintain recommended factory specifications of the Helios system. Only standard new or like-new parts shall be furnished by the Contractor. All parts shall be of current manufacture and shall have versatility with presently installed equipment. All major components and parts furnished shall carry the manufacturer s standard commercial warranty. Replaced parts are to be disposed by the Contractor after approval of COR. The Veterans Affairs Healthcare Facility shall not furnish parts, service manuals and/or test equipment for the performance of this contract. It is the responsibility of the Contractor to bring appropriate equipment and/or supplies necessary to complete the work as required. FISHER has proprietary rights to distribute the ANA testing reagents, supplies, consumables, and service plan being procured for the Helios system. AESKU is the manufacturer of the Helios system, along with the ANA testing reagents, supplies, consumables, and service. PHADIA US INC. is the exclusive U.S. distributer of AESKU products and is partnered with FISHER. Therefore, FISHER is the only contractor able to provide the required ANA testing reagents, supplies, consumables, and maintenance/support to the Helios system located at VAGLAHS. A determination not to compete this proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) Part 12 and FAR Part 13, specifically 13.106-1(b)(1) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The North American Industry Classification System (NAICS) for this requirement is, 325413 In-Vitro Diagnostic Substance Manufacturing. Product of Service Code for this requirement is 6550 In Vitro Diagnostic Substances, Reagents, Test Kits and Sets. The Small Business Administration (SBA) size standard for this sector is 1,250 Employees. This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government. A determination by the Government not to compete this proposed procurement based on the responses to this notice is solely within the discretion of the Government. All interested parties who are responsible, certified, and capable may identify their interest and may submit capability statement which shall be considered by the agency no later than 10:00 AM Pacific Time on July 18, 2020 to Samuel Han at Samuel.Han@va.gov.
