- VHAPG Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >SAT Roche Chemistry CPRR 7-Month Bridge Detroit 36C250-24-AP-4166 Effective Date: 02/01/2022 Page 1 of 4 LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C250-24-AP-4166 (1) Contracting Activity: Department of Veterans Affairs, Network/Program Contracting Office 10 in support of VISN 10 John D. Dingell VA Medical Center at 4646 John R Street, Detroit, MI 48201. 2237: 553-24-3-058-1326 (2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This procurement is for a 7-month bridge delivery order to bridge the gap between the time the current BPA expires and the instrumentation on the new BPA is installed, validated, and capable of assuming testing. Order against: FSS Contract Number: V797P-7347A Name of Proposed Contractor: Roche Diagnostics Corporation Street Address: 9115 Hague Road City, State, Zip: Indianapolis, IN 46256 Phone: 317-521-7996 (3) Description of Supplies or Services: The estimated value of the proposed action is $616,350.00. (7 Months) This 7-month bridge will continue to run patient care clinical chemistry analysis on existing ROCHE instrumentation utilizing pre-analytic specimen processing and automated track system. This system is fully integrated with the facilities Laboratory Information System and clinical Electronic Health Record System. All patient testing analysis has been validated and meets regulatory accreditation requirements. The necessity in continuing to utilize this specific vendor is due to the need to continuously provide patient care services while the newly awarded system is installed and validated. Pricing and invoicing will continue on a Cost Per Reportable Result basis under the pricing of the current contract for the 7-month bridge. (4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; Due to clinical patient care requirements we must continue to utilize the installed and validated ROCHE chemistry system until the newly awarded replacement chemistry platform is installed and validated. FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. FAR 8.405-6(b): Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. (5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: In addition to the reasons stated above, pricing is expected to remain the same as what is currently being paid on FSS BPA 36C25018A0035. However, in accordance with FAR 8.405-4, the Contracting Officer will seek a price reduction. (6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted: VetCert was searched under NAICS 334516 and 214 concerns were found. A search was conducted in DSBS using NAICS 334516 and keyword Roche Diagnostics and zero concerns were found. GSA was searched under SIN/Category 66 III, 605-6A for Clinical Analyzers, Laboratory, Cost-Per-Test Clinical Immunochemistry Analyzers High Maintenance/Complexity Analyzers, which lists 8 vendors, including Roche Diagnostics Corporation. NAICS 334516 has an SBA NMR class waiver, but chemistry CPRR contracts are not included on the list. All manufacturers of chemistry equipment are large business. Authorized distributors (small business or SDVOSB/VOSB) would not meet the NMR requirements. The VA Rule of Two and the SBA Rule of Two cannot be met. Due to the length of time required to obtain, test, and validate new equipment, this procurement will extend the utilization of the existing Roche Diagnostics chemistry equipment on a CPRR basis for up to seven months or until the new Roche Diagnostics equipment is fully functional and ready for use. (7) Any Other Facts Supporting the Justification: There are no additional facts supporting this justification. (8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: The follow-on FSS BPA to 36C25018A0035 has already been competed amongst the capable FSS vendors and award made to Roche Diagnostics Corporation. The new BPA is for a period of one (1) base year and four (4) option years. (9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
