- Acquisition Description: This is a Notice of Intent, not a request for proposal.� The National Institute of Health, Clinical Center (NIH-CC) intends to negotiate on an other than full and open competition basis with Digital Infuzion LLC. National Institute of Health's Clinical Center and its NIH Bioethics Department (collectively Program) has previously contracted with Digital Infuzion to create and maintain software and security for the Bioethics Department�s programs and applications (see contracts such as # HHSN316201200077W_75N90021F00001). On January 2024, Chief of Information Security Office (CISO) sent an e-mail message with two as-of-yet incomplete Plan of Action and Milestone (POAM) for security weaknesses. CISO approved waiver 35430 in 2019, and waiver has been in place for the security weaknesses. CISO wants the following security weaknesses corrected so waiver can be rescinded for: Weakness ID: BFP_C_2019_8 Bioethics Fellowship Program does not capture all NIH/HHS required auditable fields. Weakness ID BFP_C_2019_10 Bioethics Fellowship Program does not review audit logs to determine unusual activities. Thus, Program requires additional work from Digital Infuzion LLC (�Digital Infuzion�) to continue its current work and fix security weaknesses identified by the CISO team. Justification for Brand Name or Sole Source: FAR 16.505 (a)(4) and 16.505 (b)(2) This will be conducted with a sole source restriction to Digital Infuzion and awarded under their CIO-CS contract because Digital Infuzion has been supporting the Department of Bioethics Fellowship Application portal since award in 2016. They have created and maintained applications and portal operations for Program and are knowledgeable about the security fixes that are required. Other vendors will not be as knowledgeable with portal operations as Digital Infuzion and would require significant amounts of time and resources to learn the system and �get up to speed.� Requirement: See attached Statement of Work Place of Performance or Delivery: The contract period of performance is 09/27/2024 � 09/26/2025 This requirement will be awarded on Digital Infuzion�s NITAAC CIO-CS Contract # HHSN316201200077W. Place of Performance: NIH Clinical Center in Bethesda, MD The statutory authority for this sole source requirement is 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. THIS IS NOT A REQUEST FOR PROPOSAL.� All responsible sources that could provide the required may submit a capability statement that will be considered by email (subject line to reference NOI-CC-24-009328) by 11:00 AM eastern standard time on 09/18/2024 to: lu-chang.lu@nih.gov All responses received by the closing date of this synopsis will be considered by the Government.� A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
