- Special Notice The Department of Veterans Affairs, Network Contracting Office (NCO) 6 intends to award a Service Disable Veteran Owned Small Business (SDVOSB) Sole Source Delivery Order to Four Points Technology, LLC, for TrackCore Annual Software, Licence, and Maintenance to be used on their existing TrackCore Tissue and Implant System located at the Richmond VA Medical Center, 1201 Broad Rock Blvd. Richmond, VA 23249. Determination of this SDVOSB sole source procurement is in accordance with FAR 16.505(b)(2)(i)(E): Authority to directly contract with an SDVOSB. The Government believes the proposed Four Points Technology, LLC, is the only GWAC contract holder to provide TrackCore Annual Software, Licence, and Maintenance. Attachment 1: Request for Exception to Fair Opportunity Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Exception to Fair Opportunity Memo Acquisition Plan Action ID: 36C246-25-AP-0624 Contracting Activity: Department of Veterans Affairs, NCO 06, Richmond VA Medical Center, 652- 25-1-088-0038. Description of Action: The Richmond VA Medical Center requests Brand Name Only Trackcore Sofware, Licenses, and Maintenance for their existing Trackcore and Tissue System against parent IDIQ GWAC HHSN316201500034W, held by Four Point Technology, LLC. This request is for a Base and Four exercisable option years with a Firm fixed price effort. Description of Supplies: The proposed action is to provide brand name-only Trackcore tissue and implant tracking software for their existing Trackcore and Tissue System to include software licensing, training, labor, materials, transportation, equipment and hardware peripherals devices, and supplies used to manage the par levels of inventory, to reorder at appropriate times, and monitor the usage of products. All FDA, TJC, and any other applicable regulatory standards and laws related to the healthcare handling of biological and non-biological implants shall be met to be used in their operating room. Estmated at $. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i): ( ) FAR 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. ( ) FAR 16.505(b)(2)(i)(B): Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. This is a single source request with Four Points Technology. Four Points Technology is the sole entity able to provide implant and tissue tracking services to meet the required healthcare standards. Attachment 1: Request for Exception to Fair Opportunity Memo Format ( ) FAR 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. ( ) FAR 16.505(b)(2)(i)(D): It is necessary to place an order to satisfy a minimum guarantee. ( X ) FAR 16.505(b)(2)(i)(E): For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source . The statutory authority permitting an exception to fair opportunity for this action is 38 U.S.C. 8127(c), known as the Veterans First Contracting Program, which provides the authority to directly contract with a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a Veteran-Owned Small Business (VOSB). Rationale Supporting Use of Authority Cited Above: The market research described in paragraph eight of this document determined that limited competition is viable amongst the authorized reseller/GWAC contract holder. Four Points Technology can provide Trackcore brand name software to the Government at a fair and reasonable price under The NITAAC CIO-CS GWAC Contract # HHSN316201500034W awarded to Four Points Technology (SDVOSB) for a Contract Period of 5/1/2020 through 4/30/2025 under NAICS 541519 to issue Trackcore Software, License and Maintenance services. TrackCore is the only software that can continue to build upon VA s existing Trackcore and Tissue System. Any other brand name software cannot integrate with the currently fielded Trackcore system. Additionally, no other brand name software will be interoperable or compatible with the presently fielded Trackcore System. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort yielded no additional sources that could meet the Government s requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO), and the justification will be made publicly available. Actions to Increase Competition: The Government will continue to monitor the marketplace for any future competition. It will be surveyed to determine if other sources can provide the equipment to satisfy the Government s requirements. Attachment 1: Request for Exception to Fair Opportunity Memo Format Market Research: The Trackcore System is installed at the Richmond VA Medical Center, and the brand name software must be used to meet all their needs. Contacted LPIT Solutions, the OEM of the proprietary Trackcore System, Software, and Licenses, stated Four Points Technology, LLC, is their only authorized reseller/ service provider and will not place a quote upon request, as Four Points was awarded the NITAAC CIO-CS GWAC Contract # HHSN316201500034W to issue Trackcore Software, License and Maintenance services. Other Facts: None Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in this justification, are accurate and complete to the best of my knowledge and belief. Determination that Anticipated Cost is Fair and Reasonable: Before this multiple award GWAC contract was awarded, price analysis was conducted in accordance with FAR 15.305(a)(1), and adequate competition was established in accordance with FAR 15.403-1(c)(1)(i)(B) to ensure that the Government pays a fair and reasonable price. The pricing for GWAC HHSN316201500034W represents a discount off of the vendor s list price and has already been determined fair and reasonable at the time of award.
