- The Department of Veterans Affairs, VA Columbia Healthcare System located at 6439 Garners Ferry Road, Columbia, SC 29209 on behalf of the Birmingham Alabama Veteran s Healthcare System intends to negotiate a sole source contract with Advanced Sterilization Products Services, Inc. (ASP), Unique Entity Identifier (UEI): 947451626, a large business, specifically for continued preventative maintenance services on four (4) separate STERRAD® Systems which are owned; in use by VA Birmingham, specifically: 1). STERRAD 100NX STERILIZER, ASSET: MX1777889, SN: 1047180279, 2). STERRAD 100NX STERILIZER, ASSET: MX1777889, SN:1047180296, 3). STERRAD 100NX STERILIZER, ASSET: MX3037684, SN:5047230511 and 4). STERRAD 100NX STERILIZER, ASSET: MX3037686, SN:5047230494. The contract will replace/supersede contract number 36C24721P0747 which references a period of performance of April 30, 2021, through April 29, 2026. The replacement/superseding contract will include a Base Year and 4 additional option years, for a total of 5 contract years. The following facts document why no opportunities for competition currently exist. ASP made an independent business decision to only authorize servicing by individuals who have been trained and certified by ASP, in this specific case for STERRAD® Systems. Training is product specific. Authorized service personnel include trained ASP service employees, OEM trained third-party service providers under contract with ASP to provide service on ASP s behalf, and customers who have purchased and completed product-specific Biomed Training provided by ASP. ASP currently does not endorse or have a formal business relationship with any small business, including Service-Disabled Veteran-Owned Small Business (SDVOSB), to provide servicing of ASP systems or to supply Original Equipment Manufacturer (OEM) parts. ASP has not trained the personnel of any small business socioeconomic category on how to service ASP systems. Accordingly, ASP is the only entity authorized to provide all scheduled preventive maintenance, corrective maintenance, repairs, OEM parts, calibrations, telephone support, and full access to ASP s software for calibration and repairs for the Government. Service attempted or performed by unauthorized persons will void ASP warranties and/or service agreements for the specific system in accordance with the provisions of ASP s product warranty policy and service agreements. In addition, approved and proprietary parts are necessary to service all ASP systems. These parts are only available to ASP authorized personnel as detailed above. Based upon these facts, there are no opportunities for competition. A Justification for Other than Full and Open Competition (JOFOC) has been prepared in the contract file. FAR 13.5 Simplified Procedures for Certain Commercial Items will be utilized. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S. Code § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. The Statutory Authority Permitting Other than Full and Open Competition referenced is: Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1. The NAICS code utilized for this procurement is 811210 with a Small Business Size Standard of $34M Employees. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, Contractors may submit a capability statement, proposal, or quotation which shall be considered by the Contracting Officer. Such responses MUST be received no later than Friday, January 23, 2026, at 10:00 AM EST. All documents submitted will not be returned. All interested parties shall submit clear and convincing documentation demonstrating their capabilities to satisfy the requirement listed to forward responses by e-mail to Joseph Locke, Contracting Officer, joseph.locke@va.gov.� Responses received will be evaluated; however, a determination by the Government not to compete with the proposed procurement based upon responses received to this notice is solely within the discretion of the Government. The Department of Veterans Affairs, NCO 7, will NOT be responsible for any costs incurred by interested parties in responding to this notice of intent. Only written responses will be considered. All responses from responsible sources will be fully considered. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM) to be eligible for the award. �
