- THIS NOTICE OF INTENT IS NOT A REQUEST FOR QUOTES. A DETERMINATION NOT TO COMPETE THE PROPOSED PROCUREMENT BASED UPON RESPONSES TO THIS NOTICE IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. The Department of Veterans Affairs, VISN 02, 561 East Orange, NJ Medical Center, intends to award a firm-fixed-price single source contract to BIOMERIEUX INC to provide BIOFIRE® FILMARRAY® Torch Module Boxes to add to its existing equipment. This action is conducted under the authority of RFO Federal Acquisition Regulation (FAR) 12.102(a). The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 Analytical Laboratory Instrument Manufacturing, with a small business size standard of 1,000 employees. Market research indicates that BIOMERIEUX INC is the only source with the existing inventory, logistical infrastructure, and maintenance capability to meet the Government s full requirement. BIOFIRE equipment is only compatible with BIOFIRE Systems and the BIOFIRE® System is only available through BIOMERIEUX INC. This Notice of Intent is NOT a request for competitive proposals. However, all responsible sources who believe they can meet the Government's complete requirement are encouraged to submit a detailed capability statement. As a result of analyzing responses to this notice of intent, the Government shall determine if a solicitation will be issued. Any prospective contractor must be registered in the System for Award Management (SAM). The capability statement must be submitted via email to latriece.bruce@va.gov by 12:00 PM Eastern Standard Time (EST) February 18, 2026. The statement must provide clear and convincing evidence that the interested party has the ability to provide all equipment and services as described. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
