- 1.0 DESCRIPTION The Department of Health and Human Services (HHS), National Institutes of Health (NIH), National Eye Institute (NEI), intends to procure, on a sole source basis, software maintenance and technical support services for NextGen software products installed and in use in the NEI Clinical Center from NextGen Healthcare, Inc., at 1551 Emancipation Hwy Ste 200 Unit 1256 Fredericksburg, VA 22401-4683. The publicizing of this notice is in accordance with Revolutionary Federal Acquisition Regulation (FAR) Overhaul (RFO) 5.101(a). This acquisition will be processed under FAR Part 12 � Acquisition of Commercial Products and Commercial Services and will be made pursuant to the authority at 41 U.S.C. 1901, utilizing simplified procedures in accordance with RFO 12.201-1. Competition is being restricted in accordance with RFO FAR 12.102(a), based on the Contracting Officer�s determination that only one source is available to meet the Government�s requirements. The North American Industry Classification System code is 541519 and the business size standard is $34 million. Please see the attached requirements document titled �75P00126Q00013 � Requirements Document� for additional information. 2.0 UNIQUE QUALIFICATIONS OF THE CONTRACTOR The proposed contractor, NextGen Healthcare, Inc. is the original equipment manufacturer (OEM) of the NextGen software products currently installed at NIH/NEI and is the only entity that possesses proprietary technical knowledge, source code access, and intellectual property rights necessary to provide the required level of software maintenance and support. While third-party resellers may distribute certain baseline versions of the NextGen software, only the OEM provides manufacturer software maintenance, ongoing updates, and authorized service personnel for technical support of proprietary application software developed by NextGen Healthcare and deployed at NIH/NEI. As a result, only the OEM provides the full scope of specialized support required under this acquisition. Accordingly, NextGen Healthcare is the only responsible source capable of meeting the Government�s minimum requirements for continued operation, maintenance, and support of the installed NextGen software environment. No other supplies or services will satisfy agency requirements without unacceptable risk or substantial duplication of cost that is not expected to be recovered through competition. 3.0 RESPONSE INSTRUCTIONS This notice is not a request for competitive quotations. However, all responsible sources may submit a capability statement, which will be considered by the agency. The response and any other information furnished must be in writing and must contain material in sufficient detail to allow the Office of Mission Acquisition Solutions (OMAS) to determine if the party can perform the requirement. All responses must be sent via email to Contracting Officer, Kari Peterson, at karina.peterson@hhs.gov by no later than 11:00 am EST on Thursday, 2/19/26. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, Contractors must be registered and have valid certification through SAM.gov. Reference: 75P00126Q00013 on all correspondence.
