COMMERCE BUSINESS DAILY ISSUE OF MARCH 23,1995 PSA#1309NETHERLANDS: SEDIMENT TRAPS The following notification has been
received in GATT Document TBT/Notification G/95.55 dated 2 March 1995.
1. Member to agreement notifying: Netherlands if applicable, name of
local government involved (Articles 3.2 and 7.2): 2. Agency
responsible: Ministry for Housing, Spatial Planning and the
Environment. 3. Notified under Article 2.9.2. 4. Products covered (HS
or CCCN where applicable, otherwise national tariff heading. ICS
numbers may be provided in addition, where applicable): (A) Sediment
traps and fat separators. (B) Sediment traps and oil separators. 5.
Title and number of pages of the notified document: draft governing the
inclusion of regulations to discharge industrial effluent into public
sewers in a number of orders in council, based on Article 8.40 of the
Environment Protection Act. 6. Description of content: regulations
governing industrial effluent in public sewers originating from
institutions (I.E. based on Article 1.1. Paragraph 3, wm. suitable
institutions) to which general rules shall apply, pursuant to Article
8.40 wm. The purport of the order is, partly, to implement directive
91/271/EEC (OJEC 1 135) and partly relates to the issues connected
therewith. All orders contain articles to implement Article 11,
Paragraph 2, Directive 91/271/EEC (OJEC 1 135). In addition, industrial
effluent is subject to the requirement that industrial waste which can
be kept separate from industrial effluent cannot be discharged into
public sewers. Harmful waste materials can be discharged, in so far as
this has been expressly permitted in the relevant order. In addition,
each order contains one or more regulations which relate to the
industry in question. Invariably, the maximum permitted concentration
level is referred to. If this concentration level cannot be met without
a facility is to be installed. If a facility is to be installed, it is
to meet the requirements contained in the order. In certain cases, the
maximum permitted concentration level applies even when a facility has
been installed, whilst in other cases, the installation of the
facility may be sufficient. Facilities prescribed by mayor and alderman
in accordance with the article which implements Article 11, Para. 2,
Directive 91/271/EEC (OJEC 1 135) to guarantee the effective operation
of drains and sewers, and the effluent purification installation
(RWZI) or the processing of deposit originating from sewers or the
RWZI. 7. Objective and rationale: in connection with the implementation
of the directive included under 8., the model discharge regulation
governing sewerage 1992 which, generally, has been adopted by local
authorities, either wholly or in part, is being replaced by a statutory
system. This adjustment shall not have any negative effects on the
environment. 8. Relevant documents: reference documents: 1. Act of 2
November 1994, governing the amendment of the environment act and the
act on the pollution of surface waters (effluent) (Law Gazette 798). 2.
Model discharge regulation governing sewerage 1992, Association of
Dutch Municipalities. 9. Proposed date of adoption and entry into
force: 31 August 1995. 10. Final date for comments: 20 April 1995.
