is being circulated in accordance with Article 10.6. G/TBT/Notif.
95.57. 1. Member to Agreement notifying: NETHERLANDS. If applicable,

provided in addition, where applicable): The order implementing the
building materials resolution gives further details of a number of
subdivisions of the draft building materials resolution. This
resolution concerns granular (both primary and secondary) building
materials only. 5. Title and number of pages of the notified document:
Order Implementing the Building Materials Resolution. 6. Description
of Content: The Order Implementing the Building Materials Resolution is
based on the building material resolution. In implementation of the
national environmental policy plan, the building materials resolution
specifies the preconditions relating to environmental hygiene for the
use of residues and waste products as building materials. This is
designed on the one hand to encourage recycling and on the other to
prevent further cases of water/soil pollution. The Order Implementing
the Building Materials Resolution lays down additional technical
regulations detailing more generally worded rules in the building
materials resolution. The regulation concerns: (a) determining whether
a material can be regarded as a building material and as a result be
covered by the building materials resolution; (b) determining whether
or not a building material has been formed in conjunction with the
distinction made in the building materials resolution between formed
and non-formed building materials; (c) determing the composition of
clear ground in conjunction with the distinction made in the building
materials resolution between clean and unclean ground; (d) determining
the emissions in the soil and surface water as a conference of the
emission of polluted materials from category I and category II building
materials in conjunction with the testing of the use of these building
materials for the emission limit values given in the building
materials resolution; and (e) the isolation measures which must be
taken in accordance with the building materials resolution in the event
of use of category II building materials and one or two specific
building materials. The Order Implementing the Building Materials
Resolution also contains a small number of implementation provisions.
The Order Implementing the Building Materials Resolution will be
supplemented at a later date by a number of technical regulations
concerning, amongst other things, the definition of the position of
building materials, see the currently blank chapters and paragraphs of
the regulation. In due course this so-called second block will also be
re-notified. 7. Objective and rationale: The Order Implementing the
Building Materials Resolution is essential for the introduction of the
building materials resolution and its practical operation. 8. Relevant
documents: The Order Implementing the Building Materials Resolution
refers to the documents mentioned in the attached list. 9. Proposed
date of adoption and entry into force: 3 November 1995. 10. Final date
