States Penitentiary in Allenwood, PA., intends to formally solicit on
a sole source basis from Honeywell, Inc., a one year preventative
maintenance contract for the existing Honeywell Graphic Central Energy
Maintenance and Control System (later referred to as the ``System'').
This is a computer based monitoring and control system located at the
Federal Correctional Complex (FCC) in Allenwood. The System monitors
and collects critical Heating, Ventilation, and Air Conditioning (HVAC)
data at various equipment locations throughout the entire FCC. IT is
imperative that all existing data be monitored and recorded and be
available to the FCC. The Contracting Officer has received required
approvals for this sole source procurement. The statutory authority
permitting other than full and open competition is 41 U.S.C. 253(c)(1).
The exception which permits use of the cited statutory authority is
stated at FAR 6.302-1, ``only one responsible source and no other
supplies or services will satisfy agency requirements.'' The
communication protocol between the individual components (controllers,
microcells) of the system is unique and proprietary to each
manufacturer: therefore, one manufacturer's equipment will not
interface with another manufacturer's equipment. In addition, the
associated communication protocol and fiber optic diagrams are also
proprietary, and licensed with ``restricted rights'' information. The
maintenance/service contracts for the existing Honeywell Graphic
Central System must use Honeywell's equipment (microcells, controllers,
etc...) and existing software, or OEM software revisions, in order for
the equipment to function properly. The minimum requirement is for a
functioning integrated system which can be provided (maintained) only
by Honeywell. Consequently, Honeywell is the only known source of
service capability. Additionally, in existence are manufacturer
proprietary rights, patent laws, and unique source codes in the
computer system.The FCC does not own or possess ``limited'' or
``unlimited'' rights to the existing Honeywell operating system,
applications software, and transmission interface protocol. Hence, all
new software and modifications/maintenance of the existing software
have to be by the original system manufacturer. The existing Honeywell
Graphic Central System is also a highly specialized unique system
consisting of specialized hardware and custom software. This service
contract is being deemed available only from the original manufacturer
(Honeywell) since it is likely that award to any other source would
result in substantial duplication of cost to the Government that is not
be expected to be recovered through competition. The duplication of
cost would result from the complete replacement of the entire Central
Graphic System, training expenses, operational expenses, etc....
Implementation of another source for hardware/software maintenance
could also produce inevitable outages/downtime detrimental to
fulfilling the FCC's requirements and to operations. The contract will
provide a maintenance program in which the contractor, on a regular
basis, will perform the routine maintenance essential to keep the
System in proper operating condition. In addition, periodic efficiency
testing and adjustments will be performed to ensure energy-effective
operation of the System. A detailed service report will be provided
after each service call to ensure closed-loop performance. The
contractor will conduct or perform application, software, and hardware
support services. These support services will: ensure mechanical
systems are operating as programmed; enhance system operation to
prevent system obsolescence; and, detect early signs of deteriorating
performance and predict potential failures in order to allow advanced
corrective action. The contractor will provide preferred-customer
response to emergency service requests and will bill at preferred
maintenance labor rates. Equipment repairs approved by the Government
will be billed on a time and material basis, with the labor costs
reflecting the preferred rate. The contractor will provide qualified
personnel to conduct eight (8) hours of on-site training regarding
operating and/or programming issues. Additionally, a training package
on Graphic Central will be provided for eight (8) people - forty (40)
hours per student, on site of the FCC. This package includes training
on modifying parameters, trends, control points, alarm data, and
controller operation of the System. A performance review of the
services provided within the contract will be performed annually by the
contractor. All software being upgraded or maintained under this
contract is ``Honeywell'' brand trade name. All modifications to
existing software shall be performed in accordance with the existing
System software proprietary rights and ``restricted rights'' license.
This is to ensure system integrity and interchangeability of components
and continued system operation. The resulting maintenance service
contract must ensure continuous system operation. This service contract
would also provide system support and back-up for critical energy
management and control functions. Please address all inquiries
regarding this acquisition to the named Contracting Officer. The
issuance date of the solicitation is anticipated to be April 18, 1995,
