Jeffrey S. Compton, 202/208-2709. The Bureau of Indian Affairs (BIA),
Division of Contracting and Grants Administration is currently seeking
to identify Indian-owned businesses or Indian economic enterprises
capable of survey development, survey administration and survey
analysis and reporting of the conditions of tribal justice systems and
Courts of Indian Offenses to determine the resources and funding,
including base support, required to provide expeditious and effective
administration of justice. This is the second announcement in regards
to this survey. The first was published on or about February 24, 1995.
In accordance with the authority of the ``Buy Indian Act'' (25 U.S.C
47 as implemented by 20 BIAM 2.1), those interested Indian-owned
businesses or Indian economic enterprises having the capabilities to
perform the service(s) described in this announcement are invited to
respond. Those firms expressing interest to the first announcement need
not reply again and will be forwarded a copy of the solicitation.
Interested parties will be given a minimum of thirty calendar days from
the closing of this announcement to prepare and submit their responses
to the solicitation. The actual closing date for all responses shall
be contained in the solicitation. Any interested Indian-owned business
or Indian economic enterprise shall submit a written request for a
copy of the solicitation to the following address: Bureau of Indian
Affairs, Division of Contracts and Grants Administration, Attn: N. Kay
Holder, Mail Stop 334-SIB, 1849 C Street, NW, Washington, DC 20240.
The BIA intends to award a Firm-Fixed Price Contract with one base year
and four option years. This contract may be subject to the provisions
of the Service Contract Act of 1965, as amended. In accordance with the
Federal Acquisition Regulation (FAR) Subpart 15.4, the BIA will award
this contract based on but not limited to, the following evaluation
criteria: (1) Professional qualifications necessary to provide
satisfactory performance of required services. These qualifications
include, but are not limited to, exhibited in-house competence and
specialized experience to formulate a plan to execute the survey which
will solicit responses from as many federally-recognized tribes as
possible and the capacity to accomplish the work in the time required;
(2) Specialized experience and technical competence in the type of
work required which includes experience of in-house personnel proposed.
The organizational structure shall demonstrate independent validity in
the preparation of the survey instrument, analysis of the survey
results, and preparation of the draft and final reports; (3) Factual
documentation of contractor's in-house technical competence and
specialized experience in the execution of surveys and the preparation
of quality public reports; and (4) Past performance on contracts with
Government agencies and/or private industries in terms of (projects)
cost control, quality of work, compliance with performance schedules
and milestones, specific records of performance on previous and similar
technical work which demonstrated a continuous history of involvement
in the development and enhancement of Indian tribal justice systems.
Prospective contractors shall comply with Indian Preference
requirements as prescribed in Section 7(b) of Public Law 93-638.
Section 7(b) of Public Law 93-638 (25 U.S.C. 450e) and 48 CFR 1404.7002
require that preference opportunities in employment and training be
given to Indian/Alaskan Native individuals and preference in the award
of subcontracts. This preference in subcontracting will be strictly
enforced by the BIA. The BIA Contracting Officer shall review and
approve all proposed subcontracts and subcontractors prior to the prime
contractor entering into such subcontract(s). Qualifying Indian-owned
firms shall incur 51% of all contract performance in-house personnel.
All qualified Indian-owned firms must submit an affirmative statement
of their Indian eligibility. This announcement is subject to the
provisions of FAR Subpart 3.104-9, Certification Requirements. Contract
award may be made without discussions. No other notification of intent
to contract for the above mentioned services shall be made. This is
