The Department of Justice, Justice Management Division, intends to negotiate with Lawyers Cooperative Publishing Company, 50 East Broad Street, Rochester, NY 14649, for subscriptions to publications currently owned by the Department. The Lawyers Cooperative publications contain copyright protected information which is utilized by Department attorneys as a research and trial preparation tool. The following is a representative list of the required publications: Americans with Disabilities Decisions, California Drunk Driving Defense, Colorado Jury Instruction 3d-Civil, Cyclopedia of Federal Procedure, Expert Witnesses in Civil Trials, Federal Rules Service, Modern Constitutional Law, New York Estates Practice Guide, Pattern Deposition Checklist, Successful Techniques for Civil Trials. The information is organized and indexed as an efficient research system. The Lawyers Cooperative publications are copyright protected and thus Lawyers Cooperative is the only known source for these publications. The statutory authority for the proposed procurement is 41 U.S.C. 253 (c) (1), only one responsible source. The proposed requirements contract will supply Department locations nationwide. A solicitation does not exist for this requirement. Interested concerns must respond with written documentation, detailed data and pricing information which clearly demonstrates their ability to perform this requirement. Responses received as a result of this notice of intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses will not be considered as either proposals or bids. A determination by the Government not to open this requirement to competition based upon the written responses to this notice is solely within the discretion of the Government. The anticipated period of performance under any resultant contract will be one year and may include four (4) one-year options to extend the terms of the contract.
