COMMERCE BUSINESS DAILY ISSUE OF JULY 21,1995 PSA#1393SWEDEN: REGULATIONS ON EXHAUST EMISSION The following notification has
been received in Gatt Document TBT/Notification G/95.200 dated 4 July
1995. 1. Member to Agreement notifying: Sweden. If applicable, name of
local government involved (Articles 3.2 and 7.2). 2. Agency
Responsible: Swedish Environmental Protection Agency. 3. Notified under
Article 2.9.2. 4. Products covered (HS or CCCN where applicable,
otherwise national tariff heading. ICS numbers may be provided in
addition, where applicable): Motor vehicles subject to the provision of
the Vehicle Emission Ordinance i.e. ``Passenger Cars'', ``Light Goods
Vehicles'' and ``Heavy Goods Vehicles'' - new as well as vehicles in
use. 5. Title and number of pages of the notified document: Draft
decree with regulations on exhaust emission inspection -
(A40-Regulations). 6. Description of Content: The regulation defines
what is needed to establish compliance with the basic provisions of the
Vehicle Emissions Act and the Vehicle Emissions Ordinance. It applies
to vehicles at National Type Inspection, initial registration
inspection and inspections of vehicles in use e.g. roadworthiness
testing (both periodic at inspection stations and spot checks on the
road). The basic rule stipulates that each vehicle registered in Sweden
must be of a type covered by a manufacturer's certificate, it has to
conform to the requirements and the concerned engine family must be
covered by an exhaust emission approval. Furthermore, the equipment
essential from the emission aspect must be in proper working order. A
visual control of the existence and the functioning of this equipment
shall be performed at vehicle inspections. The inspection shall also
include measurement of tail-pipe exhaust emission or the exhaust gas
opacity in accordance with Directive 92/55/EEC. If a vehicle fails to
meet the limit values or if the exhaust system is not in proper working
order the vehicle shall be failed and subject to remedial actions. The
regulation also includes some categories that are exempted from the
basic rules. These are migrant property, inheritance goods, diplomats'
goods, amateur built vehicles, manufacturers' test vehicles and rally
cars. Such vehicles may be registered for road use even though they do
not conform to the requirements. For vehicles imported by private
persons for personal use the manufacturer's certificate required can be
replaced by other proper documentation from either the manufacturer
(E.G. EEC-Certificate of Conformity), his representative in Sweden, the
Swedish Motor Vehicle Inspection Company or competent type approval
authorities/technical services in another member state. 7. Objective
and Rationale: The main objective is to ascertain that vehicles when in
use fulfil the stipulated requirements on exhaust emission control and
to encourage the vehicle owner to properly maintain the emission
control system. 8. Relevant Documents: Vehicle Emissions Act (SFS 1986:
1386). Vehicles Emissions Ordinance (SFS 1991:1481). The new regulation
will be published in the statute book of the Swedish Environmental
Protection Agency. 9. Proposed date of adoption and entry into force:
1 September 1995 and 1 October 1995. 10. Final date for comments: 15
