Contracting Officer). 1) Background: In early 1992, the Government of
the Philippines (GOP) launched the Philippine Build-Operate-Transfer
(BOT) Program to tap private sector resouces for infrastructure
development. To support this Program, USAID engaged the services of an
international consulting firm to provide operational support to the
BOT Center, the agency tasked to promote, coordinate and monitor the
BOT program. The consulting firm was contracted to: a) build an
inventory of implementable BOT projects; b) promote and market the
Philippine BOT program; c) develop and implement an institutional
strengthening program for the BOT Center, national implementing
agencies (IAs), and local government units (LGUs); and d) undertake
policy and sectoral analyses that will directly contribute to improving
the policy, legal, regulatory and administrative environment for BOT
project implementation. Since it's launching, the Philippine BOT
Program has made great strides. Most notable among these
accomplishments are the passage of an improved BOT law which firmly
established the policy and legal frameworks for BOT project
implementation, and putting in place the basic institutional mechanisms
through which a BOT Program is to be implemented. Yet, despite the
initial successes, the Philippine BOT Program is still plagued with
many institutional, policy, administrative and legal problems which
cannot be adequately addressed by the time the current technical
assistance contract ends on November 30, 1995. For this reason, USAID
proposes to provide additional technical assistance support to the BOT
Center, with emphasis on municipal enviornmental infrastructure. 2)
Objectives of the Services: The primary goal of the follow-on technical
assistance is to advance the strategic objectives of the Mission in the
environmental sector by making available and promoting the BOT option
for financing environmental infrastructure. The specific objectives are
as follows: a) provide local governments with the capability to
undertake BOT projects, particularly, environmental infrastructure; b)
make the non-power sector BOT units functional; c) address the
remaining policy, legal, regulartory, and administrative constraints
that impede BOT implementation; d) aggressively promote and market the
Philippine BOT program; e) demonstrate the feasibility of undertaking
environmental infrastructure through BOT and similar schemes; and f)
ensure a smooth transition in the BOT Center operation. 3) Scope of
Work: To achieve the objectives stated above, the consultant will need
to accomplish the following tasks: a) Strengthen the institutional
organizations at the national and local levels: Provide a comprehensive
human resource development program designed to provide the national and
local government personnel with the motivation as well as the knowledge
to effectively implement BOT projects. The Consultant shall present a
training plan that builds on the institutional gains achieved under the
present technical assistance program. b) Build up an inventory of
implementable BOT projects: Develop new infrastructure projects, and
continue to provide technical assistance to projects began under the
current technical assistance program. Assistance will include project
selection and prioritization, developing and reviewing terms of
reference for feasibility studies (FSs) and environmental impact
assessments (EIAs), conducting FSs and EIAs, evaluation of proposals,
and developing negotiation strategies. c) Promote and market the
Philippine BOT Program; The Consultant shall assist the BOT Center to
develop and undertake an aggressive marketing and promotional campaign
to attract additional BOT investments into the country. The campaign
shall be directed at local and foreign investors, project developers,
services contractors and others who may have interests and roles to
play in the Philippine BOT program. In this regard, the Consultants's
proposal will prepare a marketing and promotional plan in which the BOT
Center will have a major proactive role. d) Improve the policy, legal,
fiscal, regulatory and administrative frameworks for BOT
implementation in the Philippines; The Consultant will undertake macro
policy and sectoral studies that will make the environment more
conducive to BOT project implementation. Among these studies are:
futher refinement of the BOT Law and its implementing rules and
regulations, revision of the Public Services Act, sectoral risk sharing
templates, preparation of model implementation agreements for
environmental infrastructure, fiscal incentive policy and a study on
developing avoided costs. e) Procure computer hardware and software for
three local government units. USAID encourages the participation to the
maximum extent possible, of small business concerns, small
disadvantaged business concerns and women-owned small business concerns
in this activity as contractor or subcontractors in accordance with
Part 19 of the Federal Acquisition Regulation. In this respect, it is
anticipated that the contractor will make every reasonable effort to
indentify and make maximum practicable use of such concerns. all other
selection evaluation criteria being found equal, participation of such
concerns may determine selection. Contract services are anticipated to
begin on or about December 1, 1995. Detailed information about this
