The following notification is being circulated in accordance with
Article 10.6. G/TBT/NOTIF.95.238. 1. Member to Agreement notifying:
Republic of Korea. If applicable, name of local government involved
(Articles 3.2 and 7.2): 2. Agency responsible: Ministry of Health and
Welfare. 3. Notified under Article 2.9.2. 4. Products covered (HS or
CCCN where applicable, otherwise national tariff heading. ICS numbers
may be provided in addition, where applicable): CCCN 2203-2208, 2402.
5. Title and number of pages of the notified document: Health Warning
Statements on Cigarette Packets and Alcoholic Beverage Bottles (2
pages). 6. Description of content: Health warnings, indicating smoking
is harmful to health, should be displayed on cigarette packets sold or
distributed within the Republic of Korea in accordance with the
requirements of the National Health Promotion Act. Such warnings should
be placed on both sides of the packet. The Minister of Health and
Welfare should notify cigarette manufacturers or importers of any
changes in the health warnings, six months prior to the date of their
enforcement. Cigarettes packed or imported before the notification of
changes, with the old health warnings, should be sold or distributed
within one year of the date of notification. It is unlawful for any
person to manufacture or import for sale or distribution within the
Republic of Korea, any alcoholic beverage designated by the enforcement
decree of the National Health Promotion Act, unless the container of
such beverages bears the statement indicating that excessive
consumption of alcoholic beverages is harmful to health. Alcoholic
beverages designated by the enforcement decree include those sold or
distributed within the Republic of Korea under the Liquor Tax Act and
those with an alcohol content of more than 17 per cent. The Minister of
Health and Welfare should notify manufacturers, bottlers or importers
of any health warnings or changes six months before the date of their
enforcement. Alcoholic beverages bottled or imported prior to the
notifications, with the old health warnings, should be sold or
distributed within one year of the date of the notification. The
provision on health warnings, however, does not apply to alcoholic
beverages manufactured or imported before the enforcement of this
regulation. Health warnings should be written in Korean and appear in
a box with a border. Any health warnings should be selected from the
warnings designated by the Minister of Health and Welfare. The warnings
should be ligible under ordinary conditions, and be on a contrasting
background. The warnings should occupy at least 20 per cent of the
surface area of the label: the typeface must be ``Gothic'' and the
print size should exceed 9 points. It should also be entered below the
brand label. 7. Objective and rationale: To protect the health of the
public and prevent chronic diseases. 8. Relevant documents: Government
