is Ms. Carol L. Bivens, (310) 363-6556. The Space and Missile Systems
Center (SMC) Satellite and Launch Control Systems Program Office
requests potential offerors for the Network Integration Contract (NIC),
Network Operations Upgrade Contract (NOUC), Range & Communication
Development Contract (RCDC), CCS Sustainment Contract (CCSC), and Range
and Communication Sustainment Contract (RCSC) contracts to submit
information addressing adherence to the established Organizational
Conflict of Interest (OCI) Clause. The OCI clause states that a
contractor may not be awarded both the integration and either the
development or the sustainment contracts unless they can comply with
the following: Separate and distinct segments of a parent corporation
may receive award of separate development/sustainment and integration
contracts provided that the parent can demonstrate to the satisfaction
of the Air Force that the segments exist with completely separate
profit centers with separate program and management organizations. To
qualify as legally, organizationally, and operationally distinct
entities, the parent must show that the entities not only exist as
separate corporations which deal with one another at arms' length but
also that the entities do not share the same facilities and be
controlled by the same sets of management personnel. Also, the entity
holding the development/sustainment contract in fact must be different
from the entity holding the integration contract. The entities must
prove the existence procedures and safeguards to the entities have been
developed to ensure that the two entities will not cross feed
information with one another to bestow an undue competitive advantage
upon one another and that will preclude the improper cross disclosure
of proprietary, source sensitive or other restricted data. At a minimum
the contractor should provide the following: 1) the potential OCI
violation, 2) the steps the contractor is taking to mitigate the
violation, and 3) the reason the contractor feels this is not a
violation. The government will decide this excption on a case by case
basis. Submit the information via e-mail to NIC@slcspo.laafb.af.mil,
NOUC@slcspo.laafb.af.mil, RCDC@slcspo.laafb.af.mil, or
CCSC@slcspo.laafb.af.mil. No more than ten (10) pages shall be
submitted for review. Information shall be submitted no later than 10
days after the date of publication. Failure to submit the requested
information may disqualify bidders. Determinations will be sent to the
contractors in writing as soon as possible. Information herein is
