C -- INDEFINITE QUANTITY CONTRACT FOR EXPERT WITNESS FOR DELAY CONSULTANT SOL N62470-96-R-8003 POC Contact Miss Bayla Mack, 804-322-8271/Mr. Dean Koepp, Head, Contract Support Branch, 804-322-8270 Architect-Engineer or Engineering Services are required for: (a) Claims Analysis - The A&E will provide the trial attorney with an independent and objective review and evaluation of the claims, including: (1) An evaluation of the technical meritof each of the alleged delay events/accelerations; (2) An evaluation of the labor hours and material necessary to perform the contract with the delay events/accelerations; (3) An evaluation of the impact, if any, of each of the delay events oncontractor performance. This shall include the prime contractor and its subcontractors; and (4) An evaluation of any contractor caused problems which may have affected contract performance either independently or concurrently with the alleged delayevents. This includes an initial meeting between the Trail Attorney and the consultant to determine the quality and quantity of documentation to be used in the analysis; (b) Pre-Trial Assistance: The contractor will be required to make recommendationconcerning but not limited to appropriate discovery requests to be made by the Government including requests for production of documents, interrogatories, requests for admissions and deposition questions; Government responses to Appellant's(construction contractor) discovery requests, development of questions to be propounded during a trial of this matter; and possible settlement of the case. This will include travel to the areas involved for the individual delivery orders; (c) CriticalPath Analysis: The contractor will be required to assess the original as planned schedule for the construction project and develop a critical path analysis, including CPM, PERT, etc., as appropriate, in order to identify the relationship between andtechnical significance of, if any, various aspects of Appellant's contract performance and other issues alleged in the claim; and (d) Expert Testimony: The contractor shall provide, if requested by the Government, personnel with exemplaryqualifications to testify at the ASBCA Hearing as expert witnesse. Such testimony will not be on behalf of the Government. Rather such expert testimony will present the expert's independent and objective analysis of the issues presented by the case,in response to questions posed by both parties counsel at the hearing. This will include travel to the area involved for the individual delivery order. The A&E must demonstrate his and each key consultant's qualifications with respect to the publishedevaluation factors for all services. Evaluation factors (1) through (7) are of equal importance; factors (8) and (9) are of lesser importance. Specific evaluation factors include: (1) Specialized experience of the firm and its expert witness in theareas of Critical Path Method (CPM) scheduling and schedule and delay analysis as it relates to construction, such as authoring of books and publications, teaching, and leading seminars, and for the contract requirements described here; (2) Professionalqualifications of the firm and its expert witness in the areas of engineering, law, and other disciplines, including graduate degrees, professional certifications/registrations with State Governments, i.e., Professional Engineer(P. E.); (3) Specialized experience of the firm in testifying and serving as expert witness in the areas of CPM scheduling and schedule and delay analysis as it relates to construction contracts, including the number of testimonies given, identificationof forums, types of construction projects, and description of issues for which testimony was given; (4) Specialized experience of the firm and its expert witness in testifying before the following forums: Armed Services Board of Contract Appeals(ASBCA); Federal Agency Boards of Contract Appeals; U. S. Court of Federal Claims (USCFC) or its predecessors; the Naval Facilities Engineering Command or any of its subordinate Engineering Field Divisions and Activities; any other Command of theDepartment of the Navy; and any branch of the Military; (5) Ability to perform multiple tasks of work to schedules; (6) Past Performance; (7) Quality Control Program; (8) Firm location and knowledge of the locality of the project (provided thatapplication of this criterion leaves an appropriate number of qualified firms, given the nature and size of the project); and (9) Volume of Work - Firms will be evaluated in terms of work previously awarded to the firm by DOD with the objective ofaffecting an equitable distrbution of DOD A&E contracts among qualified A&E firms, including small and small disadvantaged business firms and firms that have not had prior DOD contracts. The duration of the contract will be for one (1) year from thedate of an initial contract award. The proposed contract includes a one year Government option for the same basic professional skills. The total A&E fee that may be paid under this contract will not exceed $500,000. No other general notification tofirms for other similar projects performed under this contract will be made. Type of contract: Firm Fixed Price Indefinite Quantity Contract. Estimated start date is 15 February 1996.--Architect-Engineer firms which meet the requirements described inthis announcement are invited to submit completed Standard Forms (SF) 254 (unless already on file) and 255, U. S. Government Architect-Engineer Qualifications, to the office shown above. In Block 10 of the SF 255, discuss why the firm is especiallyqualified based upon synopsized evaluation factors; and provide evidence that your firm is permitted by law to practice the professions of architecture or engineering, i.e., State registration number. For selection evaluation factor (1), provide thefollowing information for only the staff proposed for this work using these column headings: ''NAME'', ''RELATED PROJECTS WORKED ON'', ''YEAR'', ''FIRM'', and ''TECHNICAL ROLE''. Use Block 10 of the SF 255 to provide any additional information desired andcontinue Block 10 narrative discussion on plain bond paper. All information must be included within the SF 255 (limited to 30 pages (front and back considered 1 page)--not less than 10 point font; every page that is not an SF 254 will be included inthe 30 page count); cover letter and other attachments will not be considered in the evaluation process. Provide a synopsis of the scope of work, point of contact and telephone number for each project listed in SF 255 Block 8. Firms having a currentSF 254 on file with this office and those responding by 4:00 p.m. EST, 4 December 1995 will be considered. Late responses will be handled in accordance with FAR 52.215-10. Neither hand carried proposals nor facsimile responses will be accepted. Firmsresponding to this advertisement are requested to submit only one copy of qualification statements. The qualification statements should clearly indicate the office location where the work will be erformed and the qualifications of the individualsanticipated to work on the contract and their geographical location.--This proposed contract is being solicited on an unrestricted basis, therefore, replies to this notice are requested from all business concerns.--The small business size standardclassification is SIC 8711 ($2,500,000).--This is not a request for proposals.
