U.S. Department of Housing and Urban Development, Office of Native
American Programs through HUD ICDBG Project B-94-SR-30-0008, has funded
the Fort Belknap Community Council for the construction of a new
College/Educational Multi-Purpose Facility to be located at the Fort
Belknap Agency, Montana. The Fort Belknap Community Council is
currently accepting separate sealed bids for both Mechanical and
Electrical Services for this project until 4:00 P.M. Local Time on the
24th day of November, 1995. Bids received prior to the deadline date
will publicly read at the Fort Belknap Community Council conference
room located at the Fort Belknap Agency, Fort Belknap Indian
Reservation, Harlem, Montana. All bids received after the deadline date
will not be accepted. Copies of the specifications will be available at
the Fort Belknap Construction Office or may be obtained by contacting
the Fort Belknap Indian Action Program at RR #1, Box 66, Harlem, MT
59526 or (406)353-4803. Each bidder shall bid all schedules. Each bid
must be accompanied by a bid guarantee equivalent to ten percent (10%)
of the bid price. Successful bidder will furnish an approved
Performance and Payment bond each in the amount of 100% of the contract
price. The work to be performed under this contract shall be
substantially complete, subject to authorized adjustments, no later
than sixty (60) consecutive calendar days after ``Notice to Proceed''.
If the said Contractor shall neglect, fail or refuse to complete the
work within the time herein specified, or any proper extension thereof
granted by the Owner, then the contractor does thereby agree, as a
part consideration for the awarding of this contract, to pay the owner
the amount specified in the Contract not as a penalty, but as
liquidated damages for such breach of contract as hereinafter set forth
for each and every calendar day that the Contractor shall be in default
after the time stipulated in the Contract for completing the work, the
sum of $200.00 per day. The work to be performed under this contract
is on a project subject to Section 7(b) of the Indian
Self-Determination and Education Assistance Act and HUD requirements
set forth at 24 CFR Section 571.503 (1992). (25 U.S.C. 450e(b)) (Indian
Act). Section 7(b) requires that to the greatest extent feasible (A)
preferences and opportunities for training and employment shall be
given to Indians and (B) preferences in the award of contracts and
subcontracts shall be given to Indian organizations and Indian-owned
economic enterprises. All rules, regulations and fees as set forth by
the Fort Belknap Tribal Employment Rights Office (TERO) shall apply.

regarding preference and compliance prior to the submission of bids.

Compliance with the Davis-Bacon Act will be required. This
advertisement for bids does not commit the Fort Belknap Community
Council to award a contract nor to pay any costs incurred in the
preparation of bid(s) or to obtain any supplies. The Fort Belknap
Community Council reserves the right to reject any and all bids, to
waive any informalities or irregularities and to re-advertise when it
