Robert W. Herting (202) 326-4160. The Pension Benefit Guaranty
Corporation (PBGC) intends to modify its existing debt collection
contract to collect various types of debts for which contractor
assistance is desired. The current contract refers to the collection of
past due premiums and associated interest and/or penalty amounts due to
PBGC, and associated interest and/or penalty amounts due the PBGC,
including pursuing legal action in various federal district courts. The
contract will be expanded to include various types of debts for which
monies are owed to the PBGC. Some examples of these are: penalties owed
pursuant to ERISA, Section 4071, judgments obtained by the PBGC, and
delinquent loan or settlement agreements. The responsibility requires
collection-related expertise, expert knowledge in the assessment of
late charges as authorized by federal regulations, and under certain
circumstances representing the PBGC, as PBGC local counsel and under
PBGC direction, as plaintiff in all U.S. federal district courts. This
work is in addition to and continuation of work already being
performed by the existing provider who is uniquely qualified to carry
out this work. In view of the provider's familiarity with the scope of
work/services and time that is has expended in learning the PBGC's
policy and procedures, it is in the best interest of the PBGC to have
the current provider to perform these tasks. Two one-year option
periods remain for performance under the current contract. It is
critical that the provider of the services must have attorneys who will
be able to represent the PBGC in federal district courts throughout the
United States and all U.S. territories; have a high degree of success
in debt recovery; and be familiar with PBGC's flat and variable premium
rate filing requirements. This is not a request for proposal. See Note
