Basic Conditions of Participation: Any suppliers may participate in this tender; provided, however, that supplier who fall under any of the following conditions or who employ any person who falls under (iv) below as their agent, manager, or employee shall not participate in this tender; (i) suppliers adjudicated to be an incompetent or quasiincom petent; (ii) suppliers adjudicated to be bankrupt, and who have not yet been reinstated; (iii) suppliers under arrangement, composition, corporate reorganization, bankruptcy or liquidation proceedings; (iv) suppliers who within the last two years, (a) wilfully did poor or faulty work in the manufacture of any products or in the performance of any services under a contract with NTT, or committed any unfair act with respect to the quality and/or quantity of any products supplied thereunder; (b) conspired with any other supplier or suppliers in application and/or tender or conclusion and/or performance of a contract with NTT with an intention to gain unfair profits; (c) interfered with any other tenderer participating in a tender or entering into or performing a contract with NTT; (d) interfered with any personnel of NTT in the performance of their duty, or refused or failed to cooperate with any personnel of NTT in the performance of their duty, at any inspection or supervision; (e) failed or refused to enter into any contract with NTT or to perfor any contract with NTT without a just reason; (f) made any false report or misrepresentation in the procedures of application and/or tender or conclusion and/or performance of a contract with NTT; (g) committed any unfair act to interfere with any other supplier or suppliers in competition in NTT tenders; or (v) suppliers who are deemed to have gained unfair advantaged in competition as a result of their direct involvement in the preparation o the final tender documentation and/or technical specifications for this tender.
