COMMERCE BUSINESS DAILY ISSUE OF MARCH 14,1996 PSA#1551HONG KONG: CONSUMER GOODS SAFETY ORDINANCES The following notification
is being circulated in accordance with Article 10.6. G/TBT/Notif.
96.38. 1. Member to Agreement notifying: HONG KONG. If applicable, name
of local government involved (Articles 3.2 and 7.2). 2. Agency
responsible: Trade and Industry Branch. 3. Notified under Article
2.9.2. 4. Products covered (HS or CCCN where applicable, otherwise
national tariff heading. ICS numbers may be provided in addition, where
applicable): Consumer goods which are defined as goods ordinarily
supplied for private use of consumption, including the packaging in
which the consumer goods are supplied. Goods set out in the following
Annex are exempted. ANNEX - Goods which fall OUTSIDE the ambit of the
Consumer Goods Safety Ordinance are set out in the Schedule to the
Ordinance. A copy of the Schedule is reproduced below: SCHEDULE - The
following are not consumer goods within the meaning ascribed by Section
2 of this Ordinance: (a) Food and water; (b) pleasure craft and similar
vessels; (c) aircraft (other than hang-gliders); (d) motor vehicles;
(e) gas, liquefied petroleum gas containers, gas appliances, gas
fittings and flexible gas tubing, as defined under the Gas Safety
Ordinance (Cap. 51). (f) electrical products; (g) pesticides; (h)
tobacco and tobacco products; (i) pharmaceutical products, poisons and
antibiotics; (j) traditional Chinese medicines; (k) toys and
children's products within the meaning of the Toys and Children's
Products Safety Ordinance (Cap. 424); (i) any other goods the safety of
which is controlled by specific legislation. 5. Title and number of
pages of the notified document: Proposed Amendments to the Consumer
Goods Safety Ordinance (CGSO) (6 pages). 6. Description of content:
SAFETY LABELLING REQUIREMENT IN BOTH ENGLISH AND CHINESE. All consumer
goods covered by the CGSO which carry safety labels should have the
labels provided in both official languages, namely English and Chinese,
when the concerned products are put on sale in the Hong Kong market. 7.
Objective and rationale: To enhance the safety of consumers. 8.
Relevant documents: Consumer Goods Safety Ordinance, Chapter 456 of the
Laws of Hong Kong. 9. Proposed date of adoption and entry into force:
Amendments will be made to the Ordinance by mid-1996. However, they
will only come into effect after the lapse of a 12-month grace period.
