SWITZERLAND: DANGEROUS SUBSTANCES PROTECTION LAW The following notification is being circulated in accordance with Article 10.6. G/TBT/Notif. 96.37. 1. Member to Agreement notifying: SWITZERLAND. If applicable, name of local government involved (Articles 3.2 and 7.2). 2. Agency responsible: Federal Office of Public Health. 3. Notified under Article 2.9.2. 4. Products covered (HS or CCCN where applicable, otherwise national tariff heading. ICS numbers may be provided in addition, where applicable): Substances, preparations and pesticides dangerous for human health. 5. Title and number of pages of the notified document: Federal Law Concerning the Protection Against Dangerous Substances and Preparations. 6. Description of content: Law to protect human life and health against harmful effects of dangerous substances and preparations and to enhance safety in the use of chemicals. It sets basic frame rules to allow harmonization with international regulations especially with those of the EU concerning the classification, packaging, labelling and the procedures concerning notifications of substances and authorizations of certain preparations. The Law encloses rules for the placing on the market, limitations, storing, information and advertising. It creates the legal base for indoor-pollution directives and for establishing requirements for persons, who are dealing and handling with dangerous chemicals. The Law also prescribes marketing control authorities and coordination procedures between them. 7. Objective and rationale: Total revision of the Federal legislation on trade in toxic substances due to technical progress and in view of harmonization with international standards especially those of the EU in order to reduce technical barriers to trade. 8.
