The Department of Energy, Nevada Operations Office (DOE/NV) intends to amend this solicitation to eliminate the small disadvantaged business (SDB) set-aside restriction and change this procurement to a small business set-aside. The DOE is currently assessing its authority to proceed with SDB restricted solicitations under the provisions of Section 7102 of the Federal Acquisition Streamlining Act of 1994 (FASA). DOE Acquisition Letter 94-20, dated December 13, 1994, which authorized DOE offices to issue SDB restricted contracts based on FASA authority has been canceled by DOE Acquisition Letter 96-03, dated February 2, 1996. The ongoing review of this matter by DOE officials has delayed our ability to proceed with a SDB procurement. The Contracting Officer has determined that the procurement cannot be further delayed pending resolution of the authorization issues, as such delay would significantly impact this office's ability to carry out its missions.
