High Energy Laser (THEL) Technology Development--Broad Agency
Announcement (BAA). (NOTE THAT THIS ANNOUNCEMENT IS BEING MADE IN TWO
PARTS DUE TO SPACE LIMITATIONS.) PART 2: Specific information and
instructions for proposal preparation follow: (1) This BAA constitutes
a solicitation and no formal request for proposal (RFP) will be
issued. This announcement will remain open through close of business 45
calendar days from the date of the announcement and proposals may be
submitted any time during this period. Offerors may submit proposals
for any number of critical technologies/concepts, but only one critical
technology/concept per proposal is permitted. Submit ten (10) copies of
the technical/management portion of each proposal and three (3) copies
of the cost portion of each proposal. (2) Any resultant contract is
expected to be Firm Fixed Price. The Government reserves the right to
select any, all, or none of the proposals received in response to this
announcement, however, for planning purposes, three (3) awards, not to
exceed $250k per award, are anticipated. The planned period of
performance of any resultant contract is six (6) months. Assume for
proposal purposes that performance will begin ninety (90) calendar days
from the date of the announcement. (3) There is no limit on the length
of the cost portion of a proposal. The offeror's combined
technical/management proposal shall not exceed 50 pages (8 1/2'' X 11''
single spaced). Proposals must be in English. The first page of the
proposal must be an executive summary of the proposed technical and
management approaches. The proposal shall include full discussion of
the scope, nature, and objectives of the proposed research effort,
rationale for the technical approach and methodology, and expected
results and their contribution to tactical air defense goals. The
proposal shall also contain a schedule of milestones, related
experience, resumes of key research personnel, and a summary
description and statement of availability of the resources necessary to
perform the proposed effort. Include in the proposal a summary
description of management planning and control systems, product
assurance, and identification of patent rights in technical data or
restricted rights in computer software, if any. (4) The following are
required to be supplied, however, they are excluded from the 50 page
limitation: Large businesses are required to submit subcontracting
plans for utilizing small and small disadvantaged businesses, a
separate Statement of Work suitable for contractual incorporation, a
cost proposal submitted on SF 1411 (in U.S. dollars only), together
with supporting detailed cost data, including subcontractor data in
accordance with Federal Acquisition Regulation (FAR) 15.804-6, and a
proposed funding profile broken down by month. (5) Following are the
titles, data item description (DID) numbers, and frequency of data
items anticipated to be delivered during contract performance: (A)
Funds & Man-Hour Expenditure Report, DI-FNCL-80331/M, (B) Scientific
And Technical Reports Summaries, DI-MISC-80048 and DI-MISC-80048/M,
which includes oral In Progress Review (IPR) presentations, as
required, and (C), a one time final report including refinement of
concept and technology development plan. (6) Notice to foreign-owned
firms: This acquisition is open at the subcontractor level to firms in
allied countries having bilateral security agreements with the United
States. Non-U.S. firm participation at the subcontractor level may
also be limited by U.S. disclosure policy and other restrictions,
depending upon the firm's proposal and information exchanges required
for contract negotiation and/or performance and on other U.S. laws and
regulations. Release of this BAA and acceptance of a resulting
proposal does not obligate the U.S. Government to release any specific
classified information. (7) Security requirements: The application of
a security classification and classification markings to the proposal
or portion of the proposal developed in response to this notice shall
be based on the provisions of the National Industrial Security Program
Manual (NISPOM) or the appropriate regulations of the allied country.
Information classified by foreign governments must be clearly
identified as such. (8) The application of a security classification
and classification markings to a proposal or portion of a proposal
developed in response to this notice shall be based on derivative
classification authority and the provisions of paragraph 11, DoD
5220.22-M. (9) Security requirements for foreign firms: Foreign firms
shall be responsible for protection of classified information provided
or generated under each contract resulting from this BAA in accordance
with (A) industrial security regulations, (B) Directions and procedures
established by the foreign government, or (C) Defense organizations as
required by the general security of information and industrial
security agreements executed by the U.S. and foreign governments. (10)
Any contract awarded as a result of this BAA must use SI (metric)
units exclusively. (11) The Government may utilize, as advisors,
Nichols Research Corporation (NRC) personnel to provide technical
analyses of the technical/management portion of selected proposals.
Contractor personnel are required to sign nondisclosure statements. The
NRC personnel are restricted by organizational conflict of interest
clauses in their contracts with USASSDC from disclosing proposal
information or using the information for any purpose outside their
contracted task. (12) BAA contact point and proposal delivery: Pursuant
to FAR 3.104, entitled ''Procurement Integrity,'' all technical
discussions and/or clarifications regarding this acquisition are
required to be directed solely to the Contracting Officer (through the
