is a combined synopsis/solicitation for commercial items prepared in
accordance with the format in FAR Subpart 12.6, as supplemented with
additional information included in this notice. This announcement
constitutes the only solicitation; bids are being requested and a
written solicitation will not be issued. This solicitation is hereby
issued as an Invitation for Bids (IFB) 407-0006. The solicitation
document and incorporated provisions and clauses are those in effect
through Federal Acquisition Circular 90-37 (last circular at
announcement publication). This procurement is being advertised as full
and open competition, under standard industrial classification code
8999, with a small business size standard of $5 million. Wage
Determination No. 94-2173 Revision 3 (7/14/95) is incorporated into
this solicitation. A) Schedule: The Contractor shall provide for the
lease of one 42 cubic yard container compatible with the existing
compactor already in place (Marathon 225VL), and shall be picked-up
weekly (52 weeks) (FCI location) (LINE ITEM ONE), The Contractor shall
provide a 42 cubic yard container with a compactor, and shall be
picked up monthly (12 times) (FPC location) (LINE ITEM TWO), for the
Base Year and four one year option periods. The Contractor shall also
provide for maintenance and disposal of all container contents, to be
included as part of the price. Please provide pricing for the items
listed above as two separate line items for (1) price per month and (2)
prices per year (price per month x 12). Please provide these prices
separately for the Base Year, Option Period One, Option Period Two,
Option Period Three, and Option Period Four. The period of performance
is as follows: the Base Year of the contract shall be from 10/01/96 -
09/30/97; Option Period One: 10/01/97 - 09/30/98; Option Period Two:
10/01/98 - 09/30/99; Option Period Three: 10/01/99 - 09/30/00; and
Option Period Four: 10/01/00 - 09/30/01. Pursuant to FAR 17.203(d)
bidders may offer varying prices for option periods. To continue
services in accordance with FAR clause 52.217-8, ``Options to Extend
Services,'' the Contracting Officer must provide written notice to the
Contractor within 14 calendar days. B) Statement of Work: I)
Purpose-To provide solid waste disposal services to the Federal
Correctional Institution, and Federal Prison Camp, Pekin, Illinois. II)
Time Schedule-Services will be provided by the vendor once per week for
the FCI, tentatively on Fridays and once per month for the FPC (time to
be arranged). If a scheduled day falls on a holiday, pick-up shall
occur on the next business day. Time of service for the FCI will be
between 4:00 am and 5:40 am on the aforementioned day. When providing
services to the FCI, the Contractor must enter the secure perimeter of
the FCI and adhere to inspection by the Gate Officer. The estimated
time to process through the secure perimeter will not normally exceed
thirty minutes. The Contractor will furnish on the monthly bill all
weight tickets for the FCI and FPC. III) Supplies and Scope of Work-All
supplies are to be furnished by the Contractor. This includes one 42
yard container with compactor, and one 42 yard self-contained container
with a compactor. Contractor shall provide all maintenance for the
compactors and respond and make repairs within one working day after
notification (24 hours). Contractor must provide for compatible
electrical hook-ups, as well as any installation that may be required.
All units and the container shall be cleaned and/or returned clean by
the Contractor. The Government reserves the right to prohibit certain
contractor employees from working under this contract due to security
reasons. IV) Performance-The Contractor's performance under this
contract will be monitored by the Contracting Officer's Technical
Representative (COTR): (a) Dennis Sharp, Facility Manager, FCI Pekin,
2600 South Second St. Pekin, Illinois 61555-7000. (309) 346-8588 Ext.
1400, is hereby designated to act as Contracting Officer's
Representative (COTR) under this contract; (b) The COTR is responsible
for: receiving all deliverables; inspecting and accepting the supplies
or services provided hereunder in accordance with the terms and
conditions of this contract; providing direction to the Contractor
which clarifies the contract effort, fills in details or otherwise
serves to accomplish the contractual Scope of Work; evaluating
performance; and certifying all invoices/vouchers for acceptance of the
supplies or services furnished for payment prior to forwarding the
original invoice to the payment office and a confirmed copy to the
Contracting Officer; (c) The COTR does not have the authority to alter
the Contractor's purview of the General Provisions clause entitled
``Changes,'' and/or modify any of the expressed terms, conditions,
specifications, or cost or the agreement. If as a result of technical
discussions it is desirable to alter/change contractual obligations or
the Scope of Work, the Contracting Officer shall issue such changes in
writing and signed. Services are to be accomplished at FCI Pekin. C)
Clauses: FAR clause 52.212-1, ``Instructions to Offerors-Commercial,''
is hereby included by reference. The following are addenda for FAR
clause 52.212-1: (1) At paragraph (c), ``Period for Acceptance of
Offers,'' the amount of time a bidder must hold its prices firm is
hereby changed. A bidder must hold the price in its bid firm for 90
calendar days from the date specified for receipt of bids. (2)
Paragraph (e), ``Multiple Offers,'' has been determined by the
Contracting Officer to be non-applicable to this solicitation and is
hereby removed in its entirety for the purpose of this requirement. (3)
Evaluation Factors for Award: Bidders are advised that bids shall be
evaluated without discussions. Award will be made to the responsible
bidder whose bid is responsive to the items of the IFB and is most
advantageous to the Government, considering only price and
price-related factors, if any, as specified in the solicitation. (4)
The following FAR provision is hereby incorporated by full reference:
FAR 52.214-10, ``Contract Award-Sealed Bidding:'' The following FAR
provisions are hereby incorporated in full text: FAR 52.216-1, ``Type
of Contract:'' The Government contemplates award of a Firm-Fixed Price
contract resulting from this solicitation; FAR 52.233-2, ``Service of
Protest:'' (a) Protests, as defined in Section 33.101 of the Federal
Acquisition Regulation, that are filed directly with an agency, and
copies of any protests that are filed with the General Accounting
Office (GAO) or the General Services Administration Board of Contract
Appeals (GSBCA), shall be served on the Contracting Officer (addressed
as follows) by obtaining written and dated acknowledgment of receipt
from: Chief, Procurement and Property Branch, Craig H. Unger, Federal
Bureau of Prisons, 320 First Street, NW, Washington, DC 20534. (b) The
copy of any protest shall be received in the office designated above
on the same day a protest is filed with the GSBCA or within one day of
filing a protest with the GAO. (c) In this procurement, you may not
protest to the GSBCA because of the nature of the supplies or services
being procured. (Contracting Officer shall strike the word ``not''
where the GSBCA is a correct forum.) (5) Business References: In order
to assist the Contracting Officer in making a responsibility
determination about a prospective contractor, in accordance with FAR
Subpart 9.104-1, it is required that each bidder provide information on
a reasonable number of recent and relevant contracts for the same or
similar items, as well as the bidder's primary financial institution
(to include contract numbers, points of contact, telephone numbers, and
any other relevant information). FAR provision 52.212-3, ``Offeror
Representations and Certifications-Commercial Items,'' shall be
completed and submitted with the bid. FAR clause 52.212-4, ``Contract
Terms and Conditions-Commercial Items,'' hereby applies to this
acquisition. The following are addenda for FAR clause 52.212-4: (1) The
following FAR clauses are hereby incorporated by reference: FAR
52.203-3, ``Gratuities;'' FAR 52.232-18, ``Availability of Funds;'' and
FAR 52.217-5, ``Evaluation of Options.'' The following FAR clauses are
hereby incorporated in full text: FAR 52.217-8, ``Option to Extend
Services:'' The Government may require continued performance of any
services within the limits and at the rates specified in the contract.
These rates may be adjusted only as a result of revisions to
prevailing labor rates provided by the Secretary of Labor. The option
provision may be exercised more than once, but the total extension of
performance hereunder shall not exceed 6 months. The Contracting
Officer may exercise the option by written notice to the Contractor
within the period specified in the Schedule; FAR 52.217-9, ``Option to
Extend the Term of the Contract:'' (a) The Government may extend the
term of this contract by written notice to the Contractor within the
first day of the ensuing option period, provided that the Government
shall give the Contractor a preliminary written notice of its intent to
extend at least 60 days before the contract expires. The preliminary
notice does not commit the Government to an extension. (b) If the
government exercises this option, the extended contract shall be
considered to include this option provision. (c) The total duration of
this contract, including the exercise of any options under this
clause, shall not exceed five (5) years. The following terms and
conditions are hereby incorporated: Security Requirements: The
Contractor agrees to adhere to all regulations prescribed by the
institution for safety, custody and conduct of inmates. The Contractor
shall not attend an institution orientation program prior to assuming
his or her duties as outlined in this contract. A security file will
be maintained on each of the contractor's employees for the contract
duration. The following information will be maintained in this file:
National Crime Information Center Check; name check (DOJ-99);
fingerprint check (FD-258); authority for release of information
(OPM-329 A); and urinanalysis test results, (as applicable and to be
determined by the institution) all in accordance with BOP P.S. 3000.2
JAR clause 2852.270-70, ``Contracting Officer's Technical
Representative:'' This clause has been included in full text under
``Performance.'' FAR clause 52.212-5, ``Contract Terms and Conditions
Required to Implement Statutes or Executive Orders-Commercial Items,''
hereby applies to this acquisition. In accordance with FAR clause
