COMMERCE BUSINESS DAILY ISSUE OF JULY 31,1996 PSA#1648FINLAND: COUNCIL OF STATE DECISION ON SUBSTANCES THAT DEPLETE THE OZONE
LAYER The Following notification is being circulated in accordance with
Article 10.6. G/TBT/Notif. 96.226. 1. Member to Agreement notifying:
FINLAND. If applicable, name of local government involved (Articles 3.2

authority designated to handle comments regarding the notification can
be indicated if different from above: 3, Notified under Article 2.9.2.
4. Products covered (HS or CCCN where applicable, otherwise national
tariff heading. ICS numbers may be provided in addition, where
applicable): This Regulation shall apply to HCFCs and HBFCs as well as
products and equipment containing such. 5. Title, number of pages and
language(s) of the notified document: Council of State Decision on
Substances that Deplete the Ozone Layer (6 pages, available in
English). 6. Description of content: The proposed decision would
restrict the use and the placing on the market of HCFCs and HBFCs as
well as products and equipment containing such, and the use and the
placing on the market of methylbromide. The use of HCFCs would be
forbidden (1) in the manufacture of rigid polyurethane foams for
building insulation as of 1 January 1997, (2) in the manufacture of
other rigid foams as of 1 January 1998, (3) in the manufacture of
integral skin foams for use in safety applications as of 1 January
1998, (4) in equipment for heat transfer with power input over 2 kW or
with refrigeration output over 10 kW, installed and manufactured after
31 December 1997, (5) in equipment for heat transfer with power input
no more than 2 kW or with refrigeration output no more than 10 kW,
installed and manufactured after 31 December 1998, and (6) as solvents
as of 1 January 1997. The placing on the market of the products and
equipment referred to in points 1 to 5 above would be forbidden
accordingly. The use of HBFCs and the placing on the market of products
and equipment containing such would be forbidden from the date of entry
into force of the Decision. The use of methylbromide and the placing on
the market of products containing such would be forbidden as of 1
January 1998. In addition, the decision would bring together the
earlier decisions on substances that deplete the ozone layer and would
abolish any overlap with the EC Council Regulation No. 3093/94. The
provisions in the earlier decisions concerning the restrictions on
import of the products containing substances that deplete the ozone
layer would be changed to restrictions concerning placing on the market
of these products. 7. Objective and rationale: Protection of the
environment. 8. Relevant documents: After the adaption the Council
decision will be published in the Statutes of Finland. 9. Proposed date
